It takes 6-8 weeks to hear if your application has been received. You need to tell your Canadian common law partner what is happening.

Tnx for your response, yah i will let her know and talk about it. They send me this letter

This is to advise you that a proceeding by the Minister under Subsection 44(2) of the Immigration and refugee protection act is to be held. The purpose of the proceeding is to determine whether:

* you shall be authorized to enter or remain in Canada,

* a removal order should be issued against you.

Is a person who is a foreign national who has been authorized to enter Canada and who, in my opinion, is inadmissible pursuant to:

Subsection 41(a) in that, on a balance of probabilities, there are grounds to believe is a foreign national who is inadmissible for failing to comply with this act through an act or omission which contravenes, directly or indirectly, a provision of this Act, specifically:

The requirement of subsection 29 (2) of the Act that the temporary resident must leave Canada by the end of the period authorized for their stay.

What should i do? Do i need to answer it? It say failure to appear for a proceeding under subsection 44(2) of Immigration will result in all relevant evidence and circumstances review n your absence by the minister delegate to determine if the report is well founded. A removal order maybe be result when the minister is of the option that report well founded.

You should go to the proceeding. I was also out of status and send in a inland sponsorship application not long before i got your exact letter telling me to appear before a proceeding. I went there and they gave me a 1 year exclusion order. I was allowed to stay for 2 more months to make arrangements but then i had to leave. The fact that i applied for sponsorship did not stop them from deporting me. Maybe if i received AIP they would have left me alone but like said here before it can take many months. So while its not nice to hear and i dont want to scare you, but be prepared that a 1 year exclusion order is very much a possibility when you go to that proceeding. Right now im applying outland and my exclusion order is up so im allowed to travel to Canada again, but it hasnt been easy. If you do get served an exclusion order, cancel your inland sponsorship asap so they refund you the money and apply outland as soon as you can. Also try to pay for your own plane ticket otherwise you have to pay them back.

Hey guys i am so worried i am heading to that proceeding this January 23 it makes me worried a lot. Do i need to bring a lawyer with me? Are they gonna detaine me?
