Inland sponsorship questions - please help !

My in land sponsorship application was send just 2 days back. I am in Canada for last 7 months on temporary resident visa. My wife is a Canadian citizen. Should I apply for restoration of legal status along with my open work permit application ? ( I have my temporary resident vosa valid till 2017 )

If your TRV is valid until 2017, there's nothing to worry about. You still have legal status until that expires.

If you'd like to submit the form for the OWP, it is form IMM 5710 and the total cost is $255. Since you did not include it with the Inland application, just make sure to inform CIC that you have already submitted the Inland application.

thank you for a quick response ponga.my concern was I have been in Canada over 6 months and on a TRV I cannot stay more than 6 months right ? For which I have to apply for restoration of legal status in Canada.

Not true. The validity of the visa only speaks to when someone can enter Canada - not how long they can stay.

The OP indicated that they have been in Canada for 7 months. Assuming they entered on the TRV, were allowed in for the normal six months and then did not apply to extend the visit - they are now out of status in Canada.

Yes my temporary resident visa is valid till 2017.So you mean I can apply for OWP by just sending IMM 5710 ? I was advised to restore my legal status ( since I have been in Canada for more than 6 months ) along with OWP . I was even told I can restore my legal status within 90 days of my legal status expiry.

You should apply for ROS now, because until that is actually approved, you wouldn't qualify for the pilot program OWP.

Once your status has been restored, apply for the OWP online.

I cannot apply for ROS and OWP together ? Since the application form is same and there are options of applying for both at one time.

How long does a person on a TRV need to leave before they are allowed back for another 6 months? I'm guessing 6 months?

No. A requirement of applying for the OWP is that a person have legal status. You must first restore your status and then apply for the OWP.

I have somewhat similar situation, my case is I haven't submitted my inland spousal application yet but in few days I will be sending my application for inland spouse PR and my legal status has already expired. So I was thinking I should send inland spousal application along with ROS and OWP . What do you suggest ?
