Inland or Outland

Hello

My fiance is on a 3 yr work permit expiring at the end of 2018 in Toronto. We are getting married shortly and will then be applying for spousal sponsorship. I have a couple questions:
1)Do we qualify for both inland and outland sposorship?
2) How long does inland typically take?
3) Is open work permit guaranteed in Inland? How soon?

He would like to be unbound from his current employer who has sponsored him sooner rather than later!

1. Yes. You have the option of submitting either application package...even though he is in Canada.

2. Forever...plus one day.

3. Yes. It takes ~ 4 months from the time CIC receives the OWP and Inland application package.


Outland is typically much faster and since he has legal status as a worker for another ~ 16 months or so, that's a much better option IMHO. Depending on his country of origin, he might even complete the entire Outland process in 6 months or less!

Where is he from?

He is from the US. How long does outland take approx? And at the end of the process does he get an open work permit? He is eager to get the open work permit!

Most U.S. citizens are completing the entire Outland process in ~ 6 months! The OWP is only available for an Inland applicant, but don't let that carrot tempt/hypnotize you/him, since an Inland application takes >3-5x to process and the applicant is cautioned NOT to leave Canada during the process.

Outland is the only logical choice...seriously.

Outland is generally very fast for Americans. At the end of the outland process, he will be a PR, which means he does not need an open work permit - he will be treated like a Canadian citizen and can apply for any job he wants, except for a few government jobs that require a security clearance.

Hi. I am very new in this website. I am in Canada for 4 years by study permit. we got married in Canada. I would like to know that can I apply as an outland? I searched every where in CIC but could not find anywhere indicates that I am allowed to apply outland. would you please advise me? my documents are ready to send inland but I know that are very long.

anyone who is eligible to apply for spousal pr can apply outland. it has nothing to do with where you physically are located, it has to do with where your citizenship is from. the "risk" for some people is that if there is an interview request, it will be held in the country that is processing the application. for those currently in canada on study/work permits, their applications are generally processed in canada through the ottawa office, so if there is an interview, it would most likely be there. this is not always guaranteed though, and it is at the descretion of CIC.

Bottom line, yes you can apply outland even if you are currently living in canada on a study permit. There is 1 line in the inland application guide that actually suggests people apply outland instead.

Thank you for your reply. Actually I finished all packaging of my documents for Inland now and is ready to ship. I was searching for paying fee, that ran into this conversation :). If I want to apply Outland, is it fine that our marriage is Canadian? I mean all my documents follow inland case.

I checked the package. It seems that I should provide other documents from my country that now I dont have :( Although processing time for Outland is much shorter, but seems that I have to apply inland !

I have to provide Birth certificate of my husband and ..... I am still hesitate about it. so sorry to say .I am afraid of being rejected or waiting in backlog. Have you seen any case of like this ? I am wondering if this is case is applicable, why people applying inland? I saw that there are some news that the processing time is going to be better. I am not sure to apply outland...

So are you going to apply for PR or is he going to apply for PR. I am a bit confused.
Is he a Canadian citizen or PR now? Why would outland require a sponsor's birth certificate.

Exactly this is! I read outland package, lots of extra documents...... Even ask to provide sponsor's passport, bcertiifcate......

Not sure what you're talking about as the basic identity documents are same for outland and inland.
