Hi all,

My boyfriend (Canadian) and I (American) are thinking of getting married and we hope to move to Canada together. Since we’ve known each other he has been on the Canadian Youth Mobility Visa in London, so we don’t qualify for the common law visa because we haven’t co-habitated for a year and the chances of me finding a job when he comes back to Canada in the fall so we can cohabitate appear slim (I'm a new grad with little work experience). The conjugal visa also seemed out of our reach because we don’t think the government would think our circumstances were dire enough to prevent our cohabitation in England. So marriage it is.

Long story short, we just want to live together as soon as possible. Now we just need help in determining if we should do inland or outland. I know the process is completed faster with the outland, but will our application be accepted if he is not in Canada when we submit it?

- His youth mobility visa expires in January 2019, but he’s coming back to Canada early –– so is it enough to write a detailed letter saying that he is coming back early and that he has a place of residence in Canada when he does?

- If we choose inland, does anyone have experience with the Open Work permit? I’m cool with hanging out for a few months waiting for it to come, but I’ve also read that I may not get my conditional residence card for up to two years which would make it hard for me to come in and out of Canada...that would not be very fun.

- So should I just go to Canada and do the inland, but possibly wait years for my residence card? Or should we get the ball rolling now with the outland and just continue the distance for another year and get all my resident/work documents at once?

Any help and/or insight on spousal visa processing times would be appreciated. Both of us are floundering in the amount of information!
 
Unfortunately you cannot submit the application without actually being married or common law. You can review the checklists and beging to gather necessary documents this way you have what you need when it comes time to submit.

While it can take up to 2 years to get copr generally it doesnt take that long. Ircc aims to have apps completed within 12 months

In order to apply inland and get an owp, you must be in canada and remain. You cannot work in canada without a permit
 
Thank you for your response! Sorry, I worded my post weird –– we are getting married in the next two months and just want to submit our application once we get our certificate.

I'm a little slow to the roll on the acronyms, what do "copr" and "ircc" stand for exactly?

I'm aware I have to stay in Canada to get the OWP, I was just wondering if the inland applications really does take THAT much longer than the outland? That's our determining factor for which application route we choose. The "no guarantee of re-entry" caveat with the OWP for the inland is just a little intimidating, given I have all my family in the US.
 
Ircc is immigration and copr is confirmation of permanent residency. Most americans apply outland as historically its faster. Inland takes about 1 year now
 
Oh okay, thank you so much. I was reading varying accounts online about the processing time. A lot of ppl made it sound like the outland takes at least a year and the inland even longer. So thanks for your help!

Inland will take about 12 months and most outland US applicants are currently being processed in about 6-8 months

So we could submit our outland when we get married even if my boyfriend/husband is still in the UK? Is it enough to write a detailed letter that he will be coming back to Canada before the visa is fully processed?

Yes, you can apply outland from the UK. Your husband would need to submit proofs to show his intent to return to Canada, such as letters/communicaton with family/friends, job searches, etc.

My soon-to-be husband and I have never lived full time w/each other and we have virtually none of the documents that the section entails (shared lease, shared property etc), but we are in the process of making a shared bank account. We also intend on gathering as many friend and family testimonial letters as possible. Will that be enough? Or are we toeing the line of being denied?

Those types of documents are only required if you are living together. If you are still not living together when you submit your app, you can skip those entirely (instead, you will need to provide proof of communication/visits/etc).
 
Really? That makes things much easier. The application is so confusing, it doesn't quite say that outright so we were confused. Thank you!

I have a question regarding the Spouse Sponsorship:

I am an Indian Citizen and currently in Canada - Toronto from last October and got my PR. I am planning to go to India and get married then file the application. OR is it better to call my spouse here in Canada and get married in Canada and then file the application. Currently she is working in USA and I don't want her to loose the job.

If she comes in Canada on Visitor VISA and get married here does it mean that she cannot go back to USA or India and continue her job?

If we married outside Canada (may be in USA, if I travel to USA) then she can continue her work there and I can continue my work in Canada until she got her PR in Canada. Is it possible?

Where I can get complete information of all the documents.
