Inland or Outland app for 2016

Hello Everyone I am reading through several post as it relates to Outland?inland Common Law Sponsorship. As such I would like some answer from the experts

1 Is it best to apply Inland/Outland?

2 Can I be in canada on a vistor visa(which I would extend) and do an Outland app?

3 Can I also apply for an OWP along with an vistor visa extension ?

4 Do I need health insurance?

5. In doing outland app would I need to visit my country to complete anything( medical,police records etc)

1. In most cases its better to apply outland as you will very likely get PR quicker than inland, find the spreadsheet on this site that indicates the length of time it is taking people to get PR through the Jamiacian office, the processing times listed on the CIC mislead people as they think it is the average time it takes.

2. Yes you can apply outland while in Canada as a visitor.

3. If you're applying outland then you don't send the OWP application like you do if you were applying inland, unless you think you will qualify for a work permit through a job offer and LMO I guess. You would just apply to extend your visitor visa

4. If you are in Canada as a visitor then yes you will want to get travel/health insurance

5. Check how it is that you can acquire police certificates in Jamaica. Medical you can do in Canada. They can request you for an interview which would be done in Jamaica.

Basically it comes down to, do you think you will get your extension OR if you don't, is it not a big deal if you have to return to Jamaica during the process? If not you might want to apply inland with a work permit before your status expires. But as you probably know, you can't leave the country for possibly 2 years.

Since you are from a visa-req country, it might be harder to get the extension, but I don't know much about that for visa-requiring countries.

Aqua you asked if I think I would get my extension granted? Im keeping the faith that it will be granted, also can I apply for an extension on wanting to qualify for common law and still do the outland sponsorship app?

Do you think its best to use an immigration lawyer?

Yes you can apply for the extension while waiting for the PR app. In fact it might help your extension to show you've applied for PR, but don't quote me on that as I don't know if they use the same policies for every country.

As for the lawyer, it depends on your case. Is it straight-forward or complicated? If it's just you and a simple common-law app, I don't see why you'd need a lawyer. If you have any past issues that would complicate things like failed refugee claims, past spousal sponsorship, criminal issues then a lawyer might be a good idea.
