Inland Family Class Spouse/Common Law Sponsorship Questions?

Hi there,

This is my first time posting in this forum, so forgive me if I'm lacking proper forum etiquette.

I am a Canadian citizen and will be sponsoring my husband's Inland Family Class PR application within the next month. We have been living abroad for the past two years and will be returning to Canada in May. Would my husband have to enter on a Visitor Visa? We have been married for 8 months (got married in Toronto), but together for 4 years and without any children or dependants. We are trying to figure out how long it will take for conditional PR to be granted? Also, if conditional PR is given do we still need to apply for at OWP? Is it better to submit the OWP application in with our PR application? What would be granted quicker?

Any information or insight on processing time and eligibility to work in Canada would be of great help!

Where is your husband from? In most cases, submitting an Outland application is much faster that an Inland one. He can submit the Outland application now, or wait until he comes to Canada as a visitor, but...why wait. Many people do not realize that an Outland applicant can be in Canada.

The OWP is only available for an Inland applicant, but it doesn't do much to ease the overall pain of the ~2-1/2 year process...for most people.

My husband is a British citizen. We are applying inland as we are moving back to Canada and would like him to start work from within the country as soon as possible. Can you clarify what conditional PR is and at what point will it be granted? I understand that every case is different and that full PR status won't be issued until approx. 2 years.

Conditional PR refers to a couple that has been in their relationship for less than 2 years, on the day the CIC receives the application. This is known as Condition: 51 and will likely apply to him. This simply means that he will need to continue to live with you for 2 years, which is probably a moot point, right? ;)

As appealing as the OWP is, you really should consider the Outland route because most applicants from the UK complete the entire process in ~ 6 months. You will find an Outland UK thread here (usually on the first or second page of this forum) which will confirm this.

If you apply inland, your husband won't get any PR statUs (conditional or not) until 26 months later. Yes he will get an OWP after 4-5 months, however after that he's basically stuck in Canada for all that time.

With an outland app there is no work permit, but he can have PR status in 6-12 months. So you sacrifice a few months of working, to get PR much more freedom in a much quicker time.

I agree with the others that it would be better for him to apply outland. Outland processing times for a British citizen are much quicker than inland. He can visit you in Canada while the application is being processed. Since he is British, he does not need a visa to enter Canada as a visitor.
Conditional PR status just means that he has to live with you for two years after becoming a PR. If the marriage breaks down before the two years are up, he could lose his PR status. However, except for this condition, people with a conditional PR have the same status as people with a 'full' PR. They can legally work in Canada, get provincial health care, etc.

Thanks to all that replied to this thread and have given a bit more info/insight into the timeline of inland vs outland. Given our situation we have decided to apply for inland.

What forms need to be completed for an OWP? Can someone attach the link of where to find the appropriate forms? Can the OWP be submitted along with our PR application?

Also, will an immigration medical need to be submitted for both the PR application and OWP? Should we request for two copies of the medical results?

When entering Canada do we need to provide border services/immigration about our intent to apply for my husband's PR? Can he enter on a one way ticket or will he need to also provide documentation of a ticket leaving Canada?

You really should go outland; it is the better choice for a Brit. It's too bad you didn't apply after you got married, as he would have been a PR any day now.

You can and should send the application for an OWP along with the inland application.

You don't have to tell the border agents about planning to apply for a PR, unless they ask of course. He has to be clear that he is entering Canada as a visitor. Don't say he is moving here. A return ticket is better; in any case, the airline may not let him board without one.

Doing the medical beforehand is optional with inland applications.
