Inland common law sponsorship OWP pilot..? and checklists..

Hi,

I read somewhere yesterday that someone mentioned that the OWP program is a pilot... Does this mean if they receive my app after Jan 31st, the OWP application would there be invalid? ..

My contract with my current employer ends when my working holiday WP ends. So on the form, would I be ticking OWP, NEW employer? They mentioned they'd be willing to extend it if I manage to get a new permit or become PR so.. not sure about that. Do I send it together with the PR forms to Mississauga, or separately elsewhere?

I was actually quite surprised at how little documents we really needed to fill out and sign.. is this all correct? No dependants, representatives, etc. Just common law partner alone only.

We have:
Police check certificate,
Proofs - photos, letters, proof of cohab etc,

I ask as when I click on the IMM5589 checklist, pretty much ALL of the links are now invalid, which is super frustrating.....

NO country specific documents (NZ) - Biometrics fee- work permit fee - IMM5669, IMM0008, IMM5406, IMM5532, IMM5589, IMM1344, and stat declaration of common law union - Some of them requires online validation, however I read that some forms were rejected as online "signature" (name) doesn't count as a "signature" and was therefore counted as an invalid form. Is this true?

Is that.. all? I really thought there would be a lot more documents we'd need to sign?..

Assume you are IEC. IEC aren't extendable so when it ends you have to stop working until you receive your OWP. No word on whether the OWP with inland sponsorship application will be continued but I assume it will. If you send in your inland sponsorship application before your IEC ends you are under implied status. If your application gets returned for some reason you lose your implied status so you may want to change your status to visitor before your IEC ends if you haven't received your AOR before your IEC expires.

IMM1344, IMM5532, 5476 Use of representative doesnt apply to us as we are not using one, IMM0008, IMM0008DEP Additional dependants declaration we don't have any dependants. Do we still print it out and just put N/A on everything?, IMM5406, IMM5609, and again IMM5476 (no representative, do we still fill this form?) We're aware we have to place the checklist on the very top, and I printed out the Application to Change Conditions or Extend Your Stay in Canada as a Worker for the OWP.

No additional forms required as that website says. I seriously think this is very little?? Please can someone tell me I'm missing something? For the forms that DO NOT apply to us, do we also fill that and put N/A in everything?

Thank you so much! Yeah I was worried and panicking as I see some other people's application that's stacked high with over 100 pages and I'm thinking mine is no way gonna be that much !

Would I have to send in photos and my passport with initial app or afterwards? I can't seem to find that checklist. I only know of the police certificate.

In the case of proofs too, do I sent in all original real copies of my bills,, old licenses letters rental agreements etc ? From what I can see on the site it looks like aside from passports, all other docs will not be returned and will be destroyed so IF there's any rejection, I'm worried they'll destroy everything I sent them and I won't have anything to reapply with (I'm very paranoid lol)

You can send copies UNLESS they have specifically requested otherwise.

Check the forms themselves and checklist carefully. Pretty certain that you are asked for birth certs (copies) and passport (copies). Photos are limited to 20 and generally used where they start asking about proving your relationship etc.

You really need to start completing the forms and working through the checklist - I think you will probably hit the 100 pages!

Send them what they ask for and relax. But DO read the questions carefully on both the forms and checklists. I know I had to send COPIES of me wifes and my birth certs and passports as they were requested, but that was 2 years ago and it was a Canadian / British combination. Just do what they questions and checklist tell you. The online help guide does say send copies unless they specifically say otherwise, and yes, they do me 'copies' and not 'notarised copies' (again unless they specifically say).

Hello QuestionTime, and the various other people helping out on this thread.

I am in roughly the same situation as you (exception being I am a Brit) and am just about ready to submit my application. So I will try give a little help back in the form of my own experience and considerable research I have done thus far to try help you out / keep this thread alive. Also in the hopes that anyone might point out any glaring mistakes/ answer a few questions that are floating around.

The biggest point of concern for people in our specific time of application is indeed this point you mentioned that the pilot is due to end within a few days. I know there are no guarantees but does anyone with any immigration law experience/ inside rumours hazard a guess at the likelihood it will continue. Also, the timescale that it will come back into practical effect. For example. Even if they go ahead with it again would it be one of the glacially slow bureaucratic things where even if it gets approved you wouldn't be able to make use of it for months/ years etc. No expectations on answers for this one as I know its unlikely anyone will know, but anything helps.

Don't take this as gospel, as I am very naiive myself so maybe completely wrong, also I am coming from a British perspective not Kiwi...but..

  • Don't forget to include the checkist itself (IMM5589 for me)
  • You are right that in your particular situation you can probably "skip" many of the sections, however the general consensus I have read is that its a bad idea to actually "skip" anything in the application. In other words even if it doesn't apply to you make sure you write N/A or something along those lines so they know you have at least acknowledged the section. Though I don't think you actually have to print/include some of them. Once again don't quote me on any of this.
  • Even So, between all the IMM forms, OWP Application, photos, supporting evidence I could imagine it being somewhere near 100 pages. If it's a LOT less than that I would be looking into a bit more.The Checklist alone is 10 pages for me.
  • I second what everyone else said, only include original if specifically asked.
  • For me passport/ Birth certificates/ passport style photo were requested in my checklist.
  • @ Canuck78 As far as the research I have done he/she would not be under Implied status when his/her IEC visa runs out regardless of a PR application. This has been a huge point of contentions on many forums and has seemed to even confuse Lawyers on occasion leading to some very disappointed individuals. And is also a reason why the OWP pilot continuation is of such importance to us people with encroaching IEC deadlines that don't want to be forced to have to either leave or stop working for long periods of time. Once again though I could be wrong.
  • The Section on the application for an OWP you mentioned "Application to Change Conditions or Extend Your Stay in Canada as a Worker" . I assume was question 3, which is asking which service/ change you are actually applying for I am also at a loss as to which one to put in our situation, if anyone can clarify?

  • The options (and my source of confusion in brackets) are:
Apparently you need to pick at least one from the top 2 and at least one from the bottom 2 or it flags as error.

Apply for work permit with same employer (I don't think this is applicable as its supposed to be an OPEN work permit so employer irrelevant)
Apply for work permit for first time or with new employer ( it's not the first time as we have IEC? still think this is the most likely to apply to us though for some reason)

And

Restore my status as worker (I think this is the most obvious as that's what we want to do)
Get a new temporary resident permit (possibly? do we have one with IEC, not sure, my naivety showing on this one)

Anyway, that's a lot of info so I wont say any more to see if anyone is still even looking at this thread.
