He has them on his, but when they entered his name into their system they saw that immigration had a warrant for him. In October they took his passport has well, they still have it. They just gave us a photocopy to use in the meantime.Smsm81 said:You mentioned your husband were stopped by police last October.
so i suggest he should always carry his documents with him all the time while outside ,just in case.
This seems to be a little bit of an overkill. Where is your husband originally from?JHWife2011 said:He has them on his, but when they entered his name into their system they saw that immigration had a warrant for him. The issue is your husband let his status run out. See my previous post to Maxlet. Filing a spousal application does not give you implied status. He needed to change his status to visitor after the work permit expired. That's most likely why you got the removal order.JHWife2011 said:my point exactly! Why the letter in the first place, her only response was "he is subject to removal" but I got that my question still is what is the basis. But my husband was stopped by police back in October, they ran his name and seen Immigration had a warranty for him, his work visa had expired, we didn't renew it we just filed the spousal application. CBSA let him go after they seen that he had an application already in process with CIC. However, he had to report to the CBSA bonding centre once a month. We've been diligent and we go every single month, on the day the ask, no questions, no problems, never had to miss a day, we are there first thing in the morning, always with required documents, easy smooth process in and out. We were just there this Monday. The CBSA agent did say that they will not know that first stage has been approved, that's why we have to show them. I'm guessing they are holding the interview to see what the status of this application process is?

They applied inland, which means they can apply while he is out of status.Linden said:The issue is your husband let his status run out. See my previous post to Maxlet. True but if the existing work permit expired prior to sending the application it does not give you implied status. JHWife2011 what was the timing of your application?God be with us said:Hi Linden,
Sending application for open work permit along with spousal sponsorship, does give implied status. This is what many of us in this forum followed, also checked with CIC.
Take care
That is true as well but you are still out of status and technically subject to a removal order but I doubt CBSA would ever go through with that.Rita27 said:They applied inland, which means they can apply while he is out of status.
but doesn't AIP restore back his status ?Linden said:The issue is your husband let his status run out. See my previous post to Maxlet. Filing a spousal application does not give you implied status. I don't think so. What would your status be? It's not permanent resident. Any senior members have an opinion on this?yata520 said:but doesn't AIP restore back his status ?
