Inland Applicant + travel

Hi All,

My PR application along with Open work permit under inland spousal sponsorship is under process. I recently received a AOR from CIC regarding my application. I m currently in Canada under visitor visa with Multiple entry valid till 2018. I landed in Canada under visitor status in Jan 17 and since the immigration officer didnt put any date with the stamp, it is valid for 6 months of stay. I have not yet received my OWP.

I am considering a short trip to the US for 3 days along with my Husband. Has anyone traveled in similar situation as mine? Please advice.

The problem with leaving the country when you have an inland application processing is that if you leave Canada for good, they consider your application to be abandoned and it is cancelled. So the risk is that if you are denied entry for whatever reason when you attempt to return to Canada, then that would happen - you will have left Canada and your application will be cancelled. Obviously it is a small risk if you expect to be granted re-entry without problems, but I know it is a risk that I would not personally take.

Thanks for the input. But, having a inland PR application process would increase the risk? Or is it the same risk when she entered Canada first time. Also, not having a OWP, is it a added risk?

Actually, the problem is that CBSA can refuse entry for any reason. Given that the OP would be seeking entry as a temporary resident (visitor, worker, student) and would also be requesting a PR, they have what is known as "dual intent" (google "cic dual intent"). So first things first, be very versed on this, and figure out how you can show significant ties to your country of origin (to prove you will leave Canada if your PR is refused).

The second problem is, although CIC does tend to tolerate "short visits" abroad, no one can say how long that is. If you are out of Canada for too long, they can deem the application abandoned. That would result in cancellation of the application.

Many, many people in the same situation have left Canada and re-entered without issue. However, a few have left and been refused re-entry. The risk is pretty small but it is always there.

No one can give you a guarantee that you will be able to re-enter.
