Hi guys. I sent my spousal sponsorship application in noveme er.
My work visa has just expired.
My lawyer has told me I cannot leave while waiting the 26mnth waiting time.
However other friends are telling me I can because I have received my open work permit.
Has anyone had this dilemma ? Or have some more input?i really want to vacation :)
 
Your OWP will not guarantee your re-entry. If you are refused, your application is toast.

Your OWP says on the bottom of it that it DOES NOT re-authorise re-entry to Canada so you can't rely on it. Your lawyer is correct. There is a risk that if you leave, and you are denied entry then your app will be cancelled.
We applied inland but were very aware we could not vacay outside of Canada - we are just not willing to take the risk. If you REALLY want to go on hol you could cancel inland and apply Outland instead. You won't get OWP but will be processed fairly fast. To me, a holiday isn't worth risking screwing up my PR app. Lots of nice places to vacay in Canada :)
 
Why not vacation in Canada? There are many beautiful places for you to safely explore, right here. ;)
 
Yes I understand.
It's not so much about vacationing as it is visiting my family in Ireland. 2 years is a long time waiting

Completely understand. Most Inland applicants live to regret their decision.

When was your Inland application received by CIC?
 
Welcome to the "CLUB" same situation here...Am home sssssick.Got OWP last NOV. Cant travel anywhere.My mum is sick going down with diabetes.Cant travel to india to see her in her last days..I cant help myself anymore.I lost my brother and 3 months later lost my niece..Am breaking into pieces...Am amazed by how slow this system is..

The thought of my mum sick and i cant be there with her destroys me...sometimes i pull over by the roadside to cry hide my tears from my wife.

Sorry to hear of your situation. You should go visit your mom. You will regret more if you miss out in seeing your mom in her last days. If you get denied entry back and your application is cancelled, you can always re-apply. What you don't get is a second chance to see your mom.

So sorry to read this. Go and see your mum. Like poster above said, you can always reapply.

this is so sad, I wonder if Justin Trudeau knows about this problem in our system, it is creating situations like this with no good reason, inland or outland should be treated with the same commitment to a timeframe, 2 year wait for inland is horrible

Unfortunately, that only allows entry, not guarantees it. There's still a risk that the OP would not be allowed back in and if that happened their application would be canceled.
 
That's dumb and cruel !! Granger..Have you tried to talk one of the CIC agents? they may be let you go and enter...if you havent called yet,call... I would call.. if they say no, call again; different agent may give you different answer.

It's not CIC that would be the one to deny re-entry...it would be CBSA.

There's no reason to call CBSA, because the only person that is guaranteed to be admitted into Canada, are citizens and permanent residents.
 
The call centre agents at the CIC helpline often do give different answers to the same question, but they have no authority to let someone back into Canada.

For the OP from Ireland, if you are an Irish citizen, you do not need a visa to enter Canada. I would just go on a vacation. Most likely you will be let back in if you have proof of your application. If they don't let you back in, well, you only applied in November, so you will not have lost much time. In fact, if they don't let you back in, reapply outland and you will most likely get your PR faster than you would have inland anyway.

For the poster from India, I am very sorry to hear about your mother. I too would leave to visit her. If you cannot get a visa to reenter Canada, abandon your inland application and reapply outland. Outland is typically faster for Indian applicants as well.
