Inland and visa extension. Very Confused. HELP please

Hi guys,

We need some help and clarification.
So here is the story: My wife is here in Canada as a visitor. Her visitor visa expires on November 9th (in a month). We are preparing inland application. Almost done with collecting all the documents ( Just waiting for FBI clearance. she was studying in US for more than 6 months.) Dont know why FBI takes so long, we sent the request on August 9th, they cashed the check Sept 9th, and we still didnt receive the document.) Regardless if we get FBI clearance or not, our lawyer said we will sent the application the latest on November 1.

My question is: Since we are applying inland, do we need to extend my wifes visitor visa? As per our lawyer ( as we all know they make mistakes as well), she stated that they never extended visitors status for inland applicants and that applicant will be under "implied status".

Can you please please please tell us is thats the case. we are really concerned and def dont want to do something wrong.

any advice is much appreciated.

Why are you applying inland??? Outland apps for US citizens are taking just 6-8 months in total these days to get full PR, some even quicker. With inland you'll be waiting 13 months just to get stage 1 approval. All US applicants should be applying outland through CPC-Ottawa office, and just maintaining visitor status in Canada if they want to stay here.

If you insist to apply inland, then you MUST submit an OWP application along with the inland app, to get implied status. If you don't submit the OWP then you won't have implied status (just submitting the inland app doesn't give you implied status) and would need to keep requesting visitor extensions.

Perhaps she is not an American, since the OP stated that she had studied in the US for more than 6 months.


In response to the FBI PCC taking so long, they implemented a new system that apparently isn't working as well as expected. Their website states that due to an IT issue, you should allow 12 weeks to receive your report.

Good point. Depending on possible visa office through (even if not CPC-Ottawa), then outland could still be a much better/quicker choice.

Absolutely! An Inland application really should be the last resort, as it's one step above a root canal (without anesthesia).

thank you guys for your replies. Yes, she is not from US, she just studied there. We dont mind the long wait, so decided to apply inland.

now the only concern is this visa extension. so if we send open work permit at the same time as our application, she will have an implied status, is that correct?

Where is she from?

And yes, as mentioned submitting OWP gives implied status with an inland app. However implied status also requires the applicant to stay inside Canada and not leave for any reason whatsoever.

In case my spouse comes as a visitor and we file an inland application, can she go back to her home country and wait there for work permit?
Is this putting our application for sponsorship or her work permit application in any danger?

kindly refrain from posting the SAME question in different threads at the same time. In reality, it will limit the amount of responses you actually get and it irritates members. This question was just answered in the other thread you posted this question in just a few minutes ago.
