I've just found out my partner needs to apply for an option c for our Outland application. He was only in the country for half of the year in 2013 so his income won't reflect the 24k needed but also he hasnt done taxes yet at all. A lawyer told me they changed it that, it doesn't matter how much you earn but providing proof is still a formality on the application. Is this true? And also..can he just show his t4?
Just to make it more complicated incase it matters...he is a server so obviously tips don't show on t4

Your lawyer was right; as long as your partner isn't collecting welfare, it doesn't matter how much he makes. Why not just order the option C? I'd give them exactly what they asked for if you can.

no, option c's are only available for the years taxes were filed. if taxes were not filed, then they need to be filed before an option c can be available.

if he can't produced an option c, then he needs to provide the alternative which is listed on the sponsor checklists. t4s are not alternative. CIC will accept 12 months of paystubs and a letter of explanation. CIC needs to be able to see he has not drawn on canadian welfare. a person can still draw on canadian welfare and work on the same time. a t4 will not show the information they are seeking.
