Hello everyone,

My sponsorship application was found ineligible based on income requirements and family size. However, I feel there is a factual error made by the IRCC officer and I am applying for reconsideration.
I applied to sponsor my parents in 2022 and I met the income requirements as per family size of 3(three) me, mom, and dad for the years 2019.2020 and 2021.
IRCC revaluated my income in 2023 they asked for 2022 option C. I do meet the requirements (as per 3) but they calculated my family size of 4 in 2022 which is factually incorrect.

I was single in 2022 and was not married till 2023. My argument is that my family size should be calculated as 3 in 2022. My spouse (not a co-signer) should be added only in and after 2023.

What do you guys think about it?

When exactly did you get married or became common law even if your spouse lived abroad.

I got married in January of 2023. My spouse is Indian national and i am applying for her permanent residency in a separate application.
Do you meet the income requirement for 2023? When exactly was your wedding ceremony not registration of your wedding.

Do you meet the income requirement for 2023? When exactly was your wedding ceremony not registration of your wedding.
marriage on January 10 2023. Haven’t filed taxes for 2023 yet. Also LICO is not out yet for 2023. I am assuming it will be close to the 2022 LICO around 64k for 4 people. I do have that much income i know.

Submit a reconsideration request.
I did submit a reconsideration and it got accepted fortunately. I am happy. IRCC is now asking me to submit my option C for 2023. However, my question is what is the Minimum income requirement as per family of 4 for the year 2023?

It's not published. I would think if you meet the $64k then you should be good.

64k for 4 adults and likely some kids. This seems crazy. Setting people up for failure. If one parent ends up in LTC how will they be able to afford 2.5k/month? They can’t. Just food and housing alone would be unaffordable in many Canadian cities.

Hi there, were they able to consider your appeal? My case was we are 4 in total but they put family size of 5 which lead to refusal as 2022 did not meet the income requirement. I stated that my parents are not together anymore for a long period of time and I only applied for my mom, I submitted a proof that they don’t live together anymore but I don’t understand why they still included other parent in the calculation.

Are they legally separated or divorced?
If so, IRCC can count only your mom. Otherwise, once she comes to Canada, she can sponsor your dad (if not legally separated or divorced).

So did you try to proof that they at least try to file for divorce or have start on getting document on separation?

This is similar to how IRCC treat people who are not living with their spouse and tried to not include them in their PR application. IRCC wants legal documents.
