I have been in Canada for just over 2 years now. I have applied for and been approved for numerous extensions and such, all very by the book. Now my previous application which was approved is now showing as refused. It dates back to August of last year and I only just found out about this yesterday when CIC emailed me of an update to my current extension application. There was no update to my current application but that's when I saw my last one was refused. I know it was approved because well how would I know my new expiration date for my stay?

My question is what do I do now? I assume that as far as CIC is concerned I should not be here now, but I only just found this out yesterday and have received no departure orders or anything of that sort. Not even a refusal letter in the mail. Should I call and talk to them and explain the situation or should I just be sure to leave Canada ask ion as possible?

I want to follow the rules to the letter as I don't want to cause any problems for myself. Please help!
 
If it were me, calling the CIC would be the first thing on my list.

I called and they said my status had expired in sept of last year sooooo I have to leave Canada now. I wasn't aware of the refusal as I was never notified of it but she said that's ok jut be sure to return to the states as soon as possible to avoid any legal action.

Ah that sucks! Weird you didn't even hear from them. Hope you get things sorted as best as possible
 
What was your reason for staying in Canada for the last two years? Do you have a spouse or partner in Canada?

If you do...one crazy option would be to apply for Inland spousal sponsorship...if you really don't want to leave Canada, because you might have trouble at the border when trying to re-enter.

I say might, because it all depends on whether or not CBSA is aware that you've overstayed.

Since you haven't received anything in writing, telling you to leave, sponsorship is an option, but it's a fair amount of work and would cost you ~ $1040.


Having said all that, I suspect that leaving would be the cleanest and easiest way to deal with this now.
