Got married in Pak and applied for my wife's sponsorship back in 2013. Wife's family had already applied for their green card and it was under process. Wife finally got her green card in 2015 and decided to move to US with her parents as it wouldve been easier for me to meet since Toronto isn't that far from NYC. My wife receives an email from Canadian high commission in Pakistan for an interview. My wife goes to Pak for the interview but during that time, we had some fights. She decided not to go for an interview. I was angry enough to email the canadian high commission and the London visa office to cancel her sponsorship. Things get normal between us and she goes back to US.

My lawyer tells me that the london visa office and the Canadian immigration will reject the case because she didnt go for the interview and on top of that, you emailed them to cancel the sponsorship. He advices me to re-apply as a new spousal sponsorship case from US, before the reject the first case. If they deny the case, than I wont be able to sponsor the same person again, be it from US or inland Canada or anywhere else.

I also find out that my wife stated her status as Single in her green card. If she had not stated her status as Single, she wouldve not received the green card in first place. Now if I sponsor my wife from US, the Canadian immigration wants to see the green card and theyll know that her status is Single. My lawyer tells me that she could get in trouble for misrepresenting the facts in her green card and she could end up losing her status in US. Also, I wont be able to sponsor her as the Canadian immigration won't allow me to sponsor her.

I am in a huge mess and have no idea what to do. Yes, we made some mistakes but there must be a way to get out of all this mess.

Basically, if i sponsor her from US, she has to attach US police record and her green card. Once the Canadian immigration goes through the record, theyll know that she isn't even married. THeyll reject the case and my wife will end up losing her green card as it falls under Misrepresentation of facts.

If I am right she got the green card by her parents right?if she was not the principal applicant,then explain to them that she went as a daughter. so her parents filled for her if m not long.any mistake there would go to them not your wife.or maybe I did not get you clearly.sorry if I didn't.
 
Yes - you do have a bit of a mess on your hands. Having said that, I'm not sure your lawyer knows exactly what he's talking about. If you try to sponsor your wife to Canada and she is refused, there is no rule stating that you can't try sponsoring her again.

It does however sound like she received her green card fraudulently (through misrepresentation).

You can't sponsor her "from the US". CIC decides where to process her application. Even if she's living in the US on a green card, CIC may still decide to send her file to London based on her citizenship. Plus even if she's processed as a US resident (in CPC-Ottawa visa office), they will have access to all her previous apps so will see she skipped the previous interview and that you asked to cancel the app.

Plus as mentioned, there is no such rule that you can't try to sponsor someone again if they are rejected once.

You should really think about firing your lawyer, he sounds like an idiot and is more likely to cause you more problems during this process.
 
It certainly sounds like a mess. her US green card status is questionable and she has contradictory information regarding her martial status. You need good legal representation
 
FYI - US gives a life-time ban for misrepresentation.

I agree you need to find a very good lawyer. Not sure the one you have now is good. I'd go for another opinion.
 
How about he tries to salvage the spousal sponsorhip first? It doesnt' sound like the wife has a refusal letter yet (unless I am wrong). He could write to LVO pleading his case. I know there are no guatantees, but it is worth the try.

Or, if you guys really want to be together, then maybe it is time for her to right the wrong. Cancel the Green card since it was obtained through misrepresentation. She can head back to Pakistan and you can submit a new application.

For now just try to salvage the current application.
