Hi There,

Me and my wife are in Australia in the process to apply for the sponsorship visa. I am canadian she is thai. Right now she just lost her student visa for Australia and has 35 days to leave to country back to thailand.

Someone suggested to claim refugee status to in Australia until we receive her Sponorship Visa for canada to buy time. Is that a bad idea?

Does CIC look at those things from another country?

Yes - CIC looks at your status in other countries and considers this in the processing of your application.

I would suggest a frivolous refugee claim in Australia is a really bad idea. CIC will be assessing the validity of your relationship as a condition of approving her PR visa. Claiming refugee status after losing a student visa is the behaviour of someone who will try anything to gain status in a western country. It will cast double on the validity of your relationship and potentially make CIC concerned she is using you to gain status in Canada.
