Hello all
If my application and doc. reach at sydney after 1000 cap is filed what going to happen? for example my application will be # 1001 at that NOC.... so what going to happen??? Are they hold it for next year or they reject it and refund my money??
thanks

I think i read somewhere they reject. I guess this is to stop a backlog at their place.

Most likely they will reject it and send it back. Either that or they will close new applications when the quota is reached. The new rules were just put in place yesterday and no one has applied yet it is too soon to tell what they do exactly. I highly doubt that they will keep your application fee if they are not going to process your application.

The only thing that can be assured is that if you are #1001, your application isn't considered anymore.

They will return your application. I'm not sure if they will still do a refund on your processing fee. (Please check link and look at #13 Appendix A of VO - Buffalo Specific Instructions.)

Based on my understanding of the new rule, the application will be returned with a written explanation and the charged fee will be refunded.

I am still not sure about that
look at this note in thire website:
Note: If you are applying under one of the 29 eligible occupations, as of June 26, 2010, a maximum of 20,000 Federal Skilled Worker applications will be considered for processing in the following 12 months. Within the 20,000 cap, a maximum of 1,000 Federal Skilled Worker applications per eligible occupation will be considered for processing each year.
what is the meaning of that part that i Bold and Underlined it?
I think they hold it for next year. Someone has to call CIC office and clear this matter. no one knows might be this 1000 filed just until 1-2 weeks. what a bout someone that read this new rull to day, and just starting gathering doucs. we had 120 days before but now everyone is ready they can file and 1000 will be filed so fast.

This means that the 1001 applicant for each NOC will not processed and 20001 applicant overall will not be processed.(even if the 1000 limit is not reached)
:(

I am pretty sure 1000 will be filled fast :(. This is seen in the US for H1B generally.

Dear All,

My best guess on this is that henceforth it will be like the U.S. system of approving work visas (H1) where one has to file from the 1st of September and the cap is 50,000 which is quickly exhaused within a few days - still this is for immigrants with master's and other specialized degrees i.e. a supposedly small pool of candidates.

Now compare with the vast numbers that will be competing for the 20,000 visas in 29 NOCs.

Sad news for any who delayed until now to file.

My guess again, CIO sure won't be keeping a humongous load of applications until the 1st of July when each new year for processing begins nor the processing fees.

Hi
below is the answer

7. What will happen with applications received after the cap is reached? How will applicants know their application isn’t being processed?

These applicants will be informed, in writing, that their application will not continue for processing and that their processing fees will be returned.

so I.T. 0213 is out?

YES, IT 0213 is out

i am sure it will not affact my case. i send my case to CIO 2months ago and waiting for response. code is 0213.
