Implied Status

Hi Everyone

My work permit is expiring soon. I want to apply for work-permit extension. I do not have LMIA requirements but till the time I get a response on my work-permit, I believe I will be on implied status. Can I work during that time?

Please help!

IRCC has made new rules to try to close this loophole. If you apply without an LMIA and IRCC rejets your app as incomplete, you will be considered out of status back to when your current work permit expired. Any work done after that time will be considered illegal.

I was also considering going back to school and enrol myself for a program for next year.
But if my permit expires before that, there will be a gap. Will I be eligible to work during that period if I come to visitor status during that time?

Since the CIC website states that if you have applied for extension of any kind of permit, you will be considered on implied status during that time and whatever status you hold currently, will be carried forward during that time.

If your are going back to school you should apply for a study permit. If you are accepted you could be intended to apply for a open work permit. This is dependent on how much time you have left on work permit.

You can not work while under a visitor visa.

As for the implied status it is you are renewing a work permit. As stated by previous member the application is likely marked incomplete and rejected because lack of LMIA

You need to apply for study permit, before your work permit expires.

So, get an offer letter from institution now and apply just couple of days before expiry.

Now, once your permit expires, I'm not 100% sure that you can work or not, since you are not requesting WP extension. Instead you going for study permit.

I suggest to consult a Immigration Lawyer. They will provide you advice for 100/hr or 150/hr.

You cannot work on implied status if you apply for study permit/visitor permit. This info clearly provided in cic website, now I'm not sure where it is exactly
