Hi, my work permit expires on Marh 26, 2014 and my husband and I will submit the application this week for sponsorship as Permanent Resident. My question is am I on implied status? The call agent scares me he said I need to get a visitor visa to keep my legal status or else I will be deported. Your advise will be highly appreciated. thanks a lot.

You will need to exit Canada and re-enter at the border to obtain a visitor visa. Depending on the mood of the border agent you will be given a visiting visa valid for up to 6 months. Note that you are not entitled to the full 6 months nor will you be given the full 6 months if you don't show hard evidence of your ties to back home or proof like a return ticket that you'll be leaving.

No they don't. You can send in an application to CIC to extend or change conditions of an existing permit, while inside Canada.

u have to extend your work permit...u have to be legal in canada while your sponsorship application is in process

If you apply to extend your current permit and it expires while you are waiting for the decision - that is implied status. Filing for PR doesn't give you implied status.

You'll have to file an application to change/extend the conditions of your current work visa. You have to do that before it expires, but you don't have to leave Canada to do it. You can file within Canada.

If your application is inland and you submit an open work permit with your application then you will be on implied status. If your application is outland then you have to apply and change your work permit to a visitor visa, you can do this online.

Based on new rules you can NOT submit OWP along with inland application anymore. You must wait for full stage 1 approval/AIP, and only then can you submit your OWP app.

Really? Well that makes it harder , so I guess the OP has no choice but to change his/her status to visitor unless he/she has LMO to extend work permit.

I think this is what the call agent was trying to tell me, that I need to change my status as a visitor visa to maintain a legal status.
He said I can submit OP together with Sponsorhip application but need to have a legal status. OP starts processing after 8 to 10 months.

Application Forms – Sponsorship of a Spouse or Common-Law Partner in Canada
To apply for permanent residence in Canada under the Spouse or common-law partner category, the sponsor must be a Canadian citizen or a permanent resident. The applicant’s (i.e. the sponsored person’s) children can be included in the same application, whether they are inside or outside Canada.

This application must be sent to the Case Processing Centre (CPC) in Mississauga, Ontario. The application is available on our Web site. You can fill out the application on-line and print it.

To help avoid delays or a refusal, make sure that you:
properly complete and sign the application form(s);
include all the documents listed on the Document Checklist (IMM 5443);
make your payment either on our Web site with a credit card or at a financial institution (e.g. a bank) with an official Receipt (IMM 5401). Please see the Fee List for the list of prices and to find out how much you need to pay; and
include the proof of payment.
An acknowledgment letter is sent only if an email address was provided in the application. No acknowledgment letter is sent by mail. Hmm yet another case I guess of call centre agents giving contradictory info, depending on who you talk to.

Would be good if someone can point to an actual link on CIC website that confirms if you can or can't send OWP app with inland app anymore, instead of people relying on call centre agents who give different answers each time you call.
