immigration lost our paperwork

Hi fellow applicants, i am just wanting to find out if ANYONE can help :) I am Australian doing the family sponsorship with my Fiance' from Nova Scotia,Via Outland. We sent off our paperwork and it arrived in Missisagua on 27th October 2011.My Fiance' went back to Canada 18th of Jan because she was at that stage 6 months pregnant ;) We had not recieved anything from immigration and by the end of Janurary we were getting Very Worried.
My Fiance' then got a hold of her local MP and they have contacts in Immigration,which were great,and they found our paperwork in the Wrong Office :( But at least we knew they had found it, Immigrations excuse was that they started using a new computer system and that is why it was lost..... But the frustrating thing is... we still have not had the first stage of sponsorship finalised,and i think we have to wait the 69 days again just to finish the first stage
Our Baby is due in May,so now i am looking at going over as a tourist for the birth and to help out my partner and be ther for this special moment. Unfortunatly i then hav to return here and wait till the whole process has gone through. The frustrating thing is that i will have to leave my partner and baby and come back to Aus. We are at the moment over 2 months behind on all of this due to the mistake made by Immigration... I understand that mistakes happen, but i wish that they had sped things through because what is going on... Anyway thats pretty much the story as to my situation, and i was just want to see if this has happened to anyone else, or anything like this has happened to anyone?? And also what happened reguarding your own situation and what u were able to do about it.... I am getting worried about all of this, and ANY help would be Greatly Appreciated :)

First just to clarify, why do you HAVE to go back to Aus afterwards? You are aware you can stay on a visitor's visa correct? (up to six months then apply for an extension) My husband is still a visitor, and we're applying outland.

It's happened before to others, and you are more fortunate, as they actually found your paperwork. Others here have had to actually re-do their entire applications from scratch! Search user IndianOcean, I know his paperwork was lost and he had to do over, but his application was finally received and sent to the visa office for processing, and doing well.

The good news is, Sydney is a fantastically efficient office, you won't be waiting too long once your file gets there. Good luck! :)

Parker24 is also correct, you don't need to leave. If you have reached the end of your 6 months' allowed stay, apply for an extension.

Thanks alot for the feedback from you both.Yes i am very happy that they found it :) As for me returning back to Aus: We had been informed that if the application had been approved while i was still in Canada,that i still had to return back here to Aus to finalize it all, and then i was able to return on the PR visa. We even checked to see if it was possible for me just to go into the states and then return back to canada, but we were told that i had to come back to Aus..... I was also informed that if the immigration officer that i speak with upon arrival into canada is suspicious of me staying permanently,that they can refuse me entry. I have saved money to show that i will not work while i am there, but i dont want to risk being sent back here when the Bub is born. I am looking at going for 10 weeks, i did kno that i could stay for up to 6 months and then extend, but i thought that the longer i wanted to stay might seem to them that i hav no intention of going back, so i thought it might be better to go for a shorter time.
I will search for the above mentioned people,and find out a little more info. Once it gets to Sydney i will feel alot better,cause i had heard that they are efficent. Thanks Alot for your help,and Best wishes for your own Applications :D

If they want an interview, then yes you would have to go back to Australia for it.
I suggest you have what you need to prove you will go back to Australia at the end of your visit: a return ticket with a specific date, enough money, proof of ties to Australia such as a letter from your boss giving you time off, an apartment lease, etc. Also bring proof that your application has been sent in and paid for. The border agents usually allow people in in this kind of situation. Then, once you are in Canada, you can always change the return date of your ticket and stay longer, extending your stay past 6 months if needed. There is no need to go back to Australia early and wait out processing there.

Hi there, as others have stated you don't have to return to Oz to finalise anything. To land all you have to do is leave Canada (ie - zip over to the states) turn around and come back in - as you can only land upon entry to Canada.

I certainly appreciate your concerns regarding being refused entry - however when you come in for the birth of your baby you will (or should be given at least 6 months).

My husband and I (I'm from the UK - he's Canadian) got married in Vegas (whilst we were living together in Alberta with me on a visitor record) - when we came back from vegas we explained to the BSO that we were applying for pr for me - they were super nice and gave me a year visa extension to get it all sorted. Due to delays on my part getting things together I had to apply for another extension (all still whilst living in Canada) and they thankfully gave me another year (because I cheekily asked for it!!!!)

Just be totally honest with them - they are not subhuman - if you are frank and open thats the best policy.

We are now hopefully awaiting ppr and then we will make a trip to the states for a weekend shopping and land upon return.

I would totally come over and stay although do make it very clear that if you are requested for any reason to return to Oz or are not given an extension, that you absolutely will go - and show you have ties there to prove it.

Thankyou Moochops and Canadianwoman for your information,it is greatly appreciated,and very helpful.I am now going to look at booking my return ticket very soon and i will book it for 5 and a half months,just to be safe:). Some more advice i am after now is; if i cant get a letter from my Boss,nor do i have a tenancy agreement, what else can i take with me to show that i have ties back here?? I will have enough money to support myself and my new family for a while,so that should be ok i think.I will be genuine and honest when i am entering and i will try to have too much paperwork to prove that i am trying to do it all By The Book:)

For a 5-and-a-half month stay, I suppose you have quit your job and left your apartment. Proof you have applied for PR should be enough: have a copy of the fees receipt, any letter from CIC (eg., accepting your partner as a sponsor), etc. That plus a return ticket and enough money should be OK. Keep in mind you are visiting, not moving to Canada, when talking to the border agent.

Thanks HEAPS Canadianwoman for your quick response,and yeah i do hav to quit my job,and i have recently left my apartment. I will take the necessary paperwork with me that you have suggested though:) And smart idea to always remember that i am only going there as a tourist.

Not sure whether it will help but maybe copies of a bank account that you have over there - although I do appreciate that these can be closed.
