Hi,

Just needed to check some things regarding immigrating.

My girlfriend is immigrating to Canada in a week or so with her family, they have all lived here in the UK all their lives but her dad is a Canadian and that's how have obtained citizenship. As a British citizen myself, I needed to know what my options are for moving out there in the future.

It'll be about a year from now that I want to apply (we'll both be 18), I just needed to check the requirements needed to gain entry as a Common Law Partner (do we need a trust fund ect.) I know we need proof we've been living together and in a relationship but if we were to live together for a year, can it be together in Canada if I lived their temporarily or is it in the UK that we need to live before I apply for residence?

Any help is much appreciated.

It can be together in Canada, or in the UK or somewhere in between, just as long as you have 12 months of provable cohabitation at a minimum.

You are visa-exempt as a British citizen, so you may be permitted to enter Canada as a visitor for up to 6 months, after which you would be required to apply to extend your status. Please note that as a visitor, you cannot work or study without applying for additional permits, so you will need to show proof of sufficient funds to support yourself for the intended duration of your stay.

Just had a query.

If we were to live in the UK for a year, when we immigrate would we need sufficient funds to show we can support ourselves or would that not be necessary if employment was to be found? Is a trust fund only necessarily for visiting/studying temporarily?

Your sponsor would need to show they are capable of supporting your basic requirements as per the sponsorship agreement without relying on social assistance. You would need to show you are capable of becoming self-supporting and establishing yourself in Canada. Proof of these would be required in the form of work history for both of you, plus a tax return for your sponsor to show sources of income, or alternatively, other sources of income such as savings and investments if you don't have work history. Your sponsor would not need to meet a minimum income requirement, however.
