Hi,

Some help and guidance would be much appreciated. Firstly I will explain my situation, I am a british citizen who married a canadian citizen last month, I came here on a visitor visa in february and that will run out in september. My wife will be sponsoring me and we are currently in the process of filling out the sponsorship application forms and the permanent residency application forms. I am currently in Canada with my wife and we are going to be applying with:

Family Class

Sponsorship of a spouse , common-law partner, conjugal partner or dependent child living outside Canada.

Application Kit.

I will be returning home to the U.K soon after I complete my medical examination and once I return home to the U.K she will be sending the application off to mississuaga. I have a couple of issues with the last few questions in the IMM5490 Sponsored Spouse/Partner Questionnaire section of the application.

Firstly Question 27. asks "Have you and your sponsor lived together?"

Do the last 5 months count as us living together even though I was only here on a visitor visa? I have spent every night with her during that time..

Secondly Question 28. asks "Are you currently living with your sponsor?"

When the forms will be sent off I will not be living with my wife/sponsor and I will be home in the U.K so the answer to this will be no either way. If I were to answer no it then asks: "When did your sponsor return to Canada?"

My wife/sponsor has never left Canada ever so I don't understand why I am being asked that. This has made me question if I am filling out the correct forms at all. Could someone please Help with these questions. Look forward to your replies, Thanks.

I sympathize. I also found this line of questioning very confusing.

Yes, you have been living together. That's what I have concluded after reading the quotation I just posted here: http://www.canadavisa.com/canada-immigration-discussion-board/living-arrangemant-urgent-guys-please-t50236.0.html;msg385908#msg385908

For the other question, you will of course have to say that you are not currently living with her, but she hasn't "returned to Canada" either. Instead, you will have returned to the UK. I think the best thing to do is to attach a separate sheet explaining these answers.

I'm pretty sure that you are indeed using the right forms. Additionally, you might say why you have returned to the UK. You do realize that it's possible to apply for an extension to your stay, do you? There is no "visa" for British citizens (who are re-admissible to the United Kingdom), so I'm assuming that you have a "visitor record"?

I agree with BeShoo. Yes, you have been living together. Especially since it has been for 5 months, which anyone would consider long enough to qualify as 'living together'. What kind of visa you are on is not important. In any case, you should clearly explain the circumstances.
Also attach an explanation that you are returning to the UK, not that your wife is returning to Canada.

You have definitely been living together. To every question that you have to answer that does not apply, or needs clarification, just attach an extra sheet and explain the situation. That way, you won't have the application sent back to you because you didn't answer something properly.

These questions are quite confusing. I also wondered about the question "did you visit your sponsor" and "did you visit your sponsor". The questions are kind of assuming you're apart or been apart when in fact I've met my boyfriend in Toronto and we've never been apart.

I wrote that no, we have not been visiting, because we have lived together for the past 7 years. But, in my case, I'm a dual canadian and us citizen and my partner is an american citizen, so we both have citizenship in the US where we've been living. I think if you've technically been a visitor, i.e. on a visit visa, your answer may be different.

Yes I guess there is no correct answer really. We've been living together for 2 years at the end of this year and he is technically visiting now... lol

The appeal case BeShoo gave a link to makes me think you had better put 'yes' we've lived together, even if it was for only two weeks or it was while one of you was on a visitor's visa. A clear explanation with the answer will at least show the visa officer you are not trying to trick them.
