Just filing in the forms now to submit next week, IMM 5540- Sponsor Questionnaire question 11 is confusing me...

It asks- "Are you currently living in Canada"

I came to Guatemala Dec 4 to spend the holidays, get married, apply for my husbands PR and give birth (in Feb). I am currently here on a tourist visa, and I plan on staying here while my husband's PR application is in process, with a trip back to canada to show the baby to my family and to keep my ontario health care coverage (I can't be gone more than 6 mths or it gets put on hold)

So do I say yes I currently live in Canada or no?

(I have my permanent address in Canada which is my parents, I also put on the other form that i my mailing address was here in Guatemala not Canada. )
We totally plan to reestablish in Canada once my husband gets his PR, wanting to go to Canada as a family and not be separated through this process... I have a letter saying I am in a hiring pool for a job, and letter from my parents saying they will help us when we get to canada.... I hope its enough, as i am not working because I am due in 3 weeks and can't possibly work!

Please advice do i currently live in canada or not? (personally i think its no, I live in Guate with my husband waiting to give birth....)

In my very nonprofessional opinion you live in Canada and are visiting you husband in Guatemala.

If you were “living” in Guatemala you should have more than a tourist visa as a tourist visa is for …..Tourists not for people “living” there. You would need something like a residence visa.

Also what would Ontario have to say concerning your health insurance if you were “living” in Guatemala?

Do you have:
A bank account in Guatemala in your name?
A driver’s license from Guatemala?
Property (deed or rental contract) in your name in Guatemala?
Is your name on utility bills in Guatemala?

If you answer no to the above questions then I would think that you live in Canada and travel frequently for extended visits to see your husband in Guatemala.
 
One thing to note... If you have your baby there and stay any length of time afterwards you will have a hard time convincing the govt that you were not outside the country for more than 6m... When i did this with my daughter OHIP revoked my card on the spot and we had to appeal/reapply.... It was pure hell!

Have you procured proper medical care for childbirth there? Are you on Canadian mat leave benefits now? Do you know if you give birth outside of canada you'll have to apply for the baby's citizenship to bring them back with you?

I know it's hard to give birth away from your significant other, but maybe you should consider giving birth in Canada and traveling back as soon as the baby has a passport (as quick as 3weeks)... I did this with my son.. It was hard but so well worth it... He had all his Canadian citizenship/ medical sorted out before we went to live with my husband in jamaica...

Also, god forbid, what if there are health issues, my seemingly perfectly healthy son has an eating condition and had to be nursed exclusively for 11 months... If I hadn't been able to meet his needs with what I produced, I knew I could return home and get him proper care, for free (the formula he would have needed costs 80 a container that's over 300cAD a week to feed him... And it would have needed to be imported so double that if I stayed in jamaica)... just knowing I had the ability to return home to our medical coverage took the stress off of me and made it possible for me to do what I needed to...


Just my thoughts from being on both sides of your situation (my daughter was born in the US tho)... I think having western health care and our Canadian health coverage is worth a family sacrifice in the long run... Trust me I know how hard it is, but it was so much more stressful to fight for my health coverage (took nearly 6m to be reinstated, and with a baby with no coverage:( ) would have been so much harder still if she had the health concerns that my son does/did
(hopefully he's outgrown it, I've managed to get him on most solids, but won't try the one that made him vomit to the point of bile and put him into shock, which was rice cereal!)

Sorry for the ramble, just wanted to share my experiences!!!

i agree also with both previous posts also from a non-professional point of view; no matter how hard it is to be away from ur loved one, it's safer for u and ur baby to be born in Canada; and as long as u still have ur medical coverage in Ontario don't tell them that u live somewhere else; plus if u r in Guatemala with a tourist visa - it's not called living, it's called visiting :)

but if u r outside and say u live in Canada make sure u sent the package from Canada and not from outside; it would look suspicious otherwise, from my point of view; u could sent it to ur family back in Canada and they will mail it for u; or, if u decide to go back, u'll mail it urself;

and the most important, r u Canadian citizen or permanent resident? if u r resident, u have to be in Canada (so ur answer to that question would be definite yes), otherwise u cannot sponsor him

on the other hand, do show ur tourist visas and passport stamps to show u visited ur husband, it's important proof
