IMM 5409? Doc request that confuses me...

Hi all!

My common-law partner and I sent his outland PR application back in May, but the CIC royally screwed up and returned it to is in July as "incomplete due to the omission of several forms" even though it wasn't (whatever brainstrust had opened our application wasn't able to distinguish the difference between an inland application and an outland application). The CIC admitted their error and claimed they were reinstating us at our original place in line (which might be due to the fact that I wrote a letter directly to the Minister of CIC whose office assured me that the mistake would be rectified). We have still experienced a 2 month + delay in the process, but after receiving our SA on September 8th, my partner (the application) received an email today requesting additional documentation including the following:

1) A scan of his passport's bio-data page
- This was included with our original application so they already have it. But I guess we have to send it again?

2) Form IMM 5409
- There is no co-signer on our application so we were informed originally that this form wasn't required. Because of that, this is setting off red flags that we have another CIC trained monkey making needless mistakes and holding up the process.

3) Our current mailing address
- Our mailing address has not changed and is up-to-date in ECAS.

Has anyone else experienced this? I really don't understand the request for IMM 5409. Also, if anyone in Vancouver has applied, do you have any suggestions as to where to go to get the signature of a Commissioner of Oaths? Is this going to throw another 2 month delay in the process? My partner's work permit is set to expire in March and we are getting quite anxious.

Any guidance is appreciated. Thank you!

Usually when visitor visa exempt countries are asked for their biometric page from passport it is because they are issuing the PR. They're probably just asking for the update address to be sure they are sending the COPR to the right place. Hurry up and just send what they're asking for!

also, i believe it's been noted by other commonlaw applicants that form is often requested (if that's the same as the statutory declaration). For some couples, CIC requires it, and no one seems to understand why. if it's strictly for a co-signer, just send it in with a big N/A written on it, referencing the fact there is no co-signer for your applciation. if it IS the statutory declaration, it seems to be needed in order to issue the visa, so just send it in.

I agree with tink. the fact they are asking for a scan copy of the passport is the PPR, and generally that means they will issue the visa as soon as all the requested docs are submitted.

We did send the IMM 5409 with our original application package with N/A written on it as we don't have a co-signer, but I suppose we'll have to get it properly filled out although I can't, for the life of me, figure out why.

I was under the impression that a passport request was generally for the physical passport and not a scanned copy?

I hope the end is near, but I'm just concerned that once we send them in we'll be booted to the back of the line again and have to wait another 2+ months.

Has anyone seen an approximate timeline of how soon after document requests COPR is issued?

yeah, again, many commonlaw applicants are reporting this form is being requested with the ppr. it seems to be required in certain circumstances.

if the applicant is visa exempt, then ONLY a scanned copy of the passport is needed, since it is not necessary for the visa office to adhere a counterfoil in the passport because it's visa exempt.

if your application is at ottawa, then you will want to take a look at the spreadsheet (in my signature below). You will be able to see the "trend" for PPR to DM. I believe the trend is anywhere from a couple of days to 4 weeks.

Just thought I'd chime in.

On August 26th 2014, my partner got the EXACT same request from CIC - for the passpost biodata page (he is American), IMM5409 and updated mailing address.

He e-mailed CIC right away to clarify why they needed form IMM5409 when we did NOT have a co-signer on the application. Their response, verbatim "We acknowledge the wording can be misleading, but indeed, you need to provide form IMM5409 bearing original signatures" - no further explanation.

We sent the documents in ASAP (according to Canada Post they were received around Sept 3rd or 4th).

Our bring forward date was around October 26th, but we still haven't heard anything from CIC. No confirmation that they received the documents, nothing. We still have "In Process" on ecas.

I wish I could provide more information, but just know that we are in the same boat.

No problem - the declarant would be you (the sponsor), and the declarant's partner would be your partner (the applicant).
