Hello everyone

I am hoping to clarify a couple of questions on this form that have me a little confused. I am sure the answers are in these forums somewhere but after spending a long time looking these are the remaining ones that I can't be sure on.

QUESTION 4: Immigration office requested for processing this application

Not sure what to put here. I am Australian, living in Canada, applying inland and am being sponsored by my Canadian common law partner. I did read on the form guide "If you are applying for refugee protection from within canada or being sponsored from within canada, this question does not apply to you."
Does that mean that I leave this blank?? I could not find any confirmation on this. Similar situations from what I saw were still putting down a Canada office. If I do need to put an office which one would I put down?

QUESTION 10: Current country of residence

For the 'to' date, as I am still living in Canada, do I put the date I submit my application, or do I put the date my current visa expires??

QUESTION 13: Provide the date on which you were married or entered into the common-law relationship

My common law partner and I began our relationship 2012-04-13 and began to live together 2012-10-24. Do I put either of these dates in there or do I put the date 2013-04-13 which is us being in a relationship together for a year and therefore I guess being recognized as being in a common-law relationship.

That is it for this form. Without assistance I would leave Q4 blank, Q10 I would put the date my visa expires and Q13 I would put 2012-04-13 so please advise me if I am totally on the wrong track!!

yes, leave vo blank as it does not apply, all inland applications are now processed in missisuaga.

use the date you sign the application, that is fine.

use 10/25/2013 as your date of becoming common law as you are only classed as common law 1 full year after beginning to live together in the same home.

Hi

Why are you applying inland? The Sydney VO is one of the fastest around; several recent applicants have had their apps processed in as little as 3 months, start to finish. Inland will take up to 16 months. I would strongly advise you to consider an outland app instead of inland. You are allowed to be in Canada when you submit an outland app.

Interesting!
I had looked at the time they posted for outland and it exceeded the time I had left on my current work visa and that is why I was opting for inland. I did all my research with this in mind. The outland has definitely increased in appeal for me though now. Can I have some people comment on my expectations for the process... more specifically if I am required to go home at any point for interviews, medicals etc.

If you are called for an interview with an outland application, you will have to go to your VO to do this. Medicals can be done wherever you are located so long as you use a CIC Panel Physician.

Also you said 'IF' I get called for an interview... does not everyone need to attend an interview?? At a guess what would be the likelihood of needing one. In my opinion we have a pretty straight forward application with no foreseeable red sirens.

VO= visa office. And no, not everyone gets called in for an interview. I know if you have a lot of red flags that the chances of being called increase exponentially, however, there are cases that are called for interview where no obvious red flags exist. Chances are likely Slim to None for you, but nobody can give you an exact answer because each case and VO are different.

The only potential caveat would be that, with an Outland application, you must maintain your legal status, if you wish to remain in Canada for the duration of the `ride'.

The likelihood of an interview is pretty much zero. Interviews are called when CIC suspects that the relationship isn't genuine and is only being used to gain status within Canada, a "Marriage of Convenience". As a visa-exempt common-law applicant from a country as equally developed as Canada, you are not an MOC risk.

You can do your medical in Canada, as long as it's with a panel physician. It is often much cheaper than doing it abroad.

If your PR app isn't done processing prior to your current permit expiring, you would need to apply to extend your stay and change your status to visitor.

Posted processing times on CIC's website are often misunderstood to be averages when they are in fact the amount of time it took to process 80% of apps. Sydney currently states 11 months. The most recent data that I could find shows 50% of spousal applications in Sydney are done within 7 months. The Sydney thread has recent apps that were done in around 3 months.

Very reassuring and I am going to look now at what few differences there are between the 2 applications. I have my current legal status until January 2015 so chances are my application would be complete well and truly before this comes about.

Yes, you would need to complete the medical beforehand.

Hi everyone!

I am trying to complete the IMM0008 form and have a couple of questions.

First of all I want to mention that I am a Canadian Citizen (by birth), I was married in Greece and had both my children born there. I have made my children Canadian Citizens (they have their Certificate of Citizenship) and we recently moved to Toronto. I am now filling out the forms to sponsor my wife, who is Greek (born in Germany!). My wife's family is living in Greece (and has no plans to come live here). They consist of a brother (who is married with children) and her parents (mother and father).

Questions:

a) in (2) where it asks for "How many family members, including you, are in this application" what should I put? My kids are already Citizens and I am only applying for my wife. So does this mean I should put "2" here? (myself and her)

b) In the dependants section, should I include the information for myself (the spouse who is also the sponsor) her parents and brother?
