Im Canadian Citizen was born in Ecuador and went to Canada when I was 4....now Im 23 got married December 2009 in Ecuador while vacationing there and meeting my grandparents. My husband is from Costa Rica, currently we are in Ecuador looking to go to his home country (Costa Rica) to spend some time with his relatives but our plans are to establish our lives in Canada.

My question is if it´s possible to apply for my husbands permanent residence while we are both in Costa Rica? What are the requirements? Do I need to show some sort of income as the sponsor? What are the steps to take?
How long would the process take?

As well I would like to inquire about a possible pregnancy during this process and would I be able to apply for my newborn´s (born outsideof Canada) Canadian Citizen.

Some of the reasons why we want to radicate in Canada are; I lived there all my life and love it there, did my studies there, my mother has reached old age and I would to look after her, and a better future for my coming children.

Sponsoring
============

i think if you are a citizen and can demonstrate intent to return to canada, you can live out of country and apply.... it's the normal process (with the addition of a letter of intent with some sort of proof (job offer, housing arrangements, signed documents from family ect)...

there is no income requirement for spouses... you may or may not need to sponsor any child you have (see below), which might add an income requirement to the mix

Having a baby outside of Canada
============================

are you a canadian citizen by birth right (one of your parents was canadian born)? or by immigration?

if the former, your child (if born outside of canada) would no longer be entitled to canadian citizenship from my understanding.. second generation born outside of canada are no longer applicable as of april last year....

if the later, then your child would be entitled to citizenship..

http://www.cic.gc.ca/EnGLish/resources/publications/citizenship.asp

hope that helps some...

Would I get information and applications at the Canadian embassy in Costa Rica to start the process?? In other words I can apply for my husband while we are both together in his country?

As for an income on my behalf it´s not necessary for me to be working in Costa Rica to show that I have an economic status to sponsor him?

And for the newborn question.....over fifteen years ago I moved to Canada with my parents and around 4 years ago we became Canadian citizens....would my children be considered the first generation so they can abide by the law if born outside Canada of a Canadian Citizen mother I could apply for their citizenship?

You can start reading here for information on how to apply and yes, you can sponsor him while outside Canada.

You are exempt of income requirements when you're sponsoring a spouse.

If you have a child outside of Canada, it would be a citizen since you are a naturalized Canadian.

Outside Canada it would take 1-2 months for the sponsorship application and 8-21 months for the residency application to process in Guatemala City, which is where he'd send his application if he's a Costa Rican citizen and doesn't have residency elsewhere.

You will use the same sponsorship application regardless of where you live. Go here and most of your questions will be answered, the application kit has a checklist among other things. You will no doubt have questions about the forms, but that's what we're here for! :)

Yes you have to notarize the document in the place where was issued, in your case Ecuador, the only thing you can do in other place is the tralastion, by an authorized traslator.

Many of your questions will be answered if you read the guide to spousal applications on CIC's website.

But on the question of translating/notarizing the marriage certificate, which is not dealt with extensively in the website, the government of Ecuador might (if asked) certify the original marriage certificate, and might even provide an official English translation. I know the government of China did for us.

If not, then get an officially-approved translator (ask the Canadian embassy n Ecuador or Costa Rica for the list) to produce an English copy (including the translator's seal or signature).

Good luck.

I´m having a look at all the requirements for me as the sponsor......for the income area as far as I am concerned I dont have to show any proof of income since it´s my husband im sponsoring.....(do remember I am living outside Canada with my husband in his home country of Costa Rica)

> there´s a section (income C print out) where I´m suppose to get a notice of assesment from Revenue Canada......first off I´m not in Canada so I dont know how I would get that....??? what would I provide to them in that case....do i still need to fill that income section even though I dont have any income at the moment?'

>in order to qualify as a sponsor I read you can not be under Social Assistance.....in my case I was under social assistance last year(2009) around the month of october for a very short period of 3 months and the last month was october......I got married December 2009....I will be applying for my husbands residence aprox in July or August 2010......as the sponsor would that period I recieved social assistance affect me to qualify as my husbands sponsor????

> and my last question is....in order to pay the fees for all the applications and the principal applicant fee I need a bar code or receipt with a number to make the payment and when i print out the applications this code doesnt appear....how do I make the payments then since Im not in Canada to order the applications that come with that bar code????

Thank You!! for anyone that helps me :)

You can pay your fees online from the website, when they are done and you print it off it will give you the number.
You do not have to have an option C printout since you are living outside Canada.
The notorized marriage cert.is good.
The social assistance i believe you must pay back to them.
