IEC Working Holiday Expired & Implied Status

Hi All,

I am wondering if anyone has been in the following situation concerning IEC permit & implied status:

1. Attempted to apply for IEC 2015 but due to an oversight / and missing documents filled out i.e. I had been approved for a conditional acceptance letter, but unable to submit a CIC application within 10 days. I did submit a CIC application but accidentally selected - to change a condition, extend a work permit which was totally a wrong document to submit (I needed to submit an application outside of Canada). I did submit my WP 30 days before my IEC Working holiday visa permit expired on 25th November 2015. I understand this WP will not be attended by CIC immigration till Feb 2016.

I need to travel for 3x weeks from Jan to Feb 2016, but because I am currently on implied status, I am afraid I will lose this status when I attempt to re-enter Canada.

Does anyone know of any strong immigration lawyers out there that could give me a signed letter that I can still come back to Canada as a worker? I know I made a human error within my IEC application and I am hoping someone can help me out. My local MP here in downtown Toronto is currently assisting with my case, but I just want to see if there are any other positive solutions out there. I can't really apply for IEC 2016 forms because I am already 31. I was 30 years old when I attempted to apply for IEC 2015 in August of this year.

If anyone can help, that would be awesome!

IECs don't benefit from implied status - they are a special class of work permit that can't be extended.

If your IEC expired on November 26th then you should have stopped working then. Any work after this date isn't legal.

If you had been holding a different kind of work permit (e.g. regular closed work permit), you would in fact have implied status until a decision in your application is made and could continue working legally without issue. But again, this doesn't apply to IECs.

Thanks for the clarification Scylla. Is there anything that can be done to apply for IEC 2016 even though I am now 31 years old? I made a human mistake in the application process with IEC 2015 and I met the age eligibility. I would assume I need an immigration lawyer right now to address my matter...

No, and you assume wrongly: a lawyer can not do anything to override normal CIC procedures/regulations. An unfortunately, CIC don't care about human error on your part.

I agree with the above. You're out of luck. A lawyer isn't going to be able to fix this.

If you want to remain in Canada and work, you would need to find an employer who is willing to offer you a full time job offer and also obtain an approved LMIA so that you can obtain a closed work permit tied to that specific employer.
