Hi all,
I have a bit of a doozy for you - I want to supply a possible scenario and to see if my thinking is feasible.
I am currently on an IEC Working Holiday Visa (Open Work Permit) from January 26th, 2023 until January 25th, 2025. I am currently working for a company in my field and I will be with them for a year in May 2024. I plan to apply for Express Entry with CEC as soon as I can and will be hoping that I can secure a PNP or ITA before my time comes to an end on my OWP in January 2025.
I met my current Canadian girlfriend (she is a citizen) in December of last year and we have madly fallen in love. Given the current visa situation, she has asked me to move in with her house from May 1st, 2024. We are going to start common law proceedings and formalise everything before we move in to start the official date of cohabitation from that date. If I fail to secure an ITA and nomination up until the end of my OWP at the end of January 2025 - I have read that I can extend my stay on a visitor visa (I am well aware that I will be seen as a tourist and won't have access to healthcare, credit cards etc that someone with a work visa would).
My main question and sticking point that I can't seem to find anywhere online is if I stay in the country as a visitor with the purposes of becoming common law - will they allow me to stay if I don't work and stay for three months, continuing to live off of savings and sort of supported by my partner? The aim is in May of 2025, to apply for common law status between the two of us and then have spousal sponsorship follow on from that. I can't seem to find any direct mentions on the IRCC website and wanted to pick the brain of the forum to confirm my thinking. If I need to, I may need to head back to Australia and wait for my CEC Express Entry to be approved. Supporting myself whilst on a visitor visa won't be an issue if that helps - I just don't want to circumvent the visa conditions and do this the correct way - but also stay around to be able to claim common law cohabitation.
