hi everyone

i am ladyboy from philippines, last year my partner decided to moved philippines and give up everything on his country just to spent his life with me for bieng together. during that time we rented house here in cebu and we also invest salon business. after 11 months of living happily together we didnt expect that we recieved problem about my partner work and he needs to return canada immediately and he cancel his philippines permanent residency. two months before his flight for going back his home, i tried to apply visitor visa. my partner wrote a letter that our purpose to visit is to meet his family and his best friend as well. and during our trip we stay to his father house. my partner also sent bank satement and he wrote on the letter that he will be the one who asume our expenses during the trip. I also sent our documents like house contract, business permit from Barangay, contract of lease of our salon, and receipts of motor cycle to prove that i will return my country. but unfortunately im still denied for obtaining visitor visa. the reason why because i dont have travel history and i didnt convince CIC that i will return my country.

4 months ago my partner arrived canada and he already submit our application to CIC for PR as conjugal partner. we supposed to apply common law but we didnt complete 365 days of living together. before my partner leave philippines he decided to sell our salon coz i cant manage alone. we also sold our motor cycle and we lost everything. its very difficult for me having this kind situation specially my partner far away from me.

please advise me what should requiremets i could prepare before applying temporary residency visa while waiting PR?

With a PR app in process, a recent TRV refusal and even less ties to your home country than when you applied before, there is pretty much no chance of being approved for a TRV.

your partner applied for PR and you lived together less than a year.
there is a chance that your app would get rejected.
only way I can think is you can cancel the app and reapply for outland PR as a married couple.
it seems like this is only way for you now.

hope other members give you better idea and good luck.

yes my partner already apply PR inland as conjugal partner
we will not able to apply as married couple coz were not married yet
and here in my country same sex marriage not allowed.
we cant apply common law coz we didnt complete 365 days of living together
spouse visa good only for married.

yes, i know it would be very difficult to obtained TRV but i will apply
trv when i will recieve sponsorship. coz i beleive having sponsoriship approve it could help my application.

Actually he submitted your PR application OUTLAND, not inland. Since you are living outside of Canada an inland app is not possible. Your outland app will be processed in Manila.

Conjugal app may have a chance here, as it's illegal to marry in Philippines and you were denied TRV to Canada. Hope you submitted lots of proofs of your conjugal married-like relationship.

Since you were already denied once I doubt you will be successful for a TRV if you apply again. With a PR app in progress it will be even more difficult. You may need to just wait in Philippines for your app to finish processing, or have him visit you again, or go to another country to meet.

yes, before we apply PR we submit all the documents like house contract, mails from 2013 to 2015, pictures that we are together with my family and friends. all bills that we have. when my partner returned canada he started to bought new things like house, car, furniture and everything that he needs. and i understand that he cant afford to visit me this winter coz plane ticket is quite expensive and aside from that my partner prepare me to visit him in canada but the problems is very difficult to obtaine TRV.
do you think outland app much more better than inland app?

Unless you can enter Canada (for which you'll need a visa) you won't be able to apply as inland will you?

Your partner has already submitted the PR app, so there's really no point for you to worry about the inland option (which you couldn't have done anyways).

If your partner has already submitted the pr application, I don't think there's much you can do about it. Try to apply for a TRV if that's really a test of luck. Some get it, most don't. You need to have a lot of money and a lot of reasons to go back to the Philippines.

If the TRV gets refused and the Conjugal Partnership gets refused as well, you can get married in another country that has more lenient immigration policies. It will be very expensive but at least you can save yourself the pain. After which you can apply for a Spousal Sponsorship. W

That is what my partner and I did. Since I was refused a visit visa to Canada and she couldn't live her with me in our country we decided to tie the knot. We all know same sex marriage isn't legal in the Philippines, so we got married in New Zealand.

Initially we considered common law/conjugal but our immigration lawyer advised against it.

maybe TRV i could be refuse. but i dont think that PR application as conjugal partner refuse too because we had lot of documents to prove CIC that our relationship genuine. i met my partner july 2013 then he moved philippines for permanent residency sept 2014 to july 2015 and we live together 10 in half months. i dont know if my partner willing to marry me in another country because he did already on his ex. because of happen of his past relationship for him married just only a papers and i will respect him.

my partner also hired immigrant consultant and she is the one who works our application. im looking forward that our PR application will be approve.

Correct me if im wrong, you are worried because one requirement for a common law app is to live together for 12 mos.
When you and your partner live together for 10 1/2 mos?

Sorry bout that. Misunderstood you. you can try applying for TRV though ive heared its hard to get one especially if you have an application in process or you can just wait.

yes, it's very difficult to obtain TRV but i will try to reaply TRV when sponsorship approve. i also heared this site saying that

Two of the things that helped make the application successful:
1. Wait until your sponsorship is approved.
2. Provide lots of evidence that your spouse will be returning to their country after a visit.
