I am on a work permit and have worked more than a year now. Do I need a NEW job offer to get CRS score?

Hi everyone,

Tried to search an answer for this but no luck. Apologies if there is another thread with the same topic.

I came to Canada about 1.5 year ago on a work permit. It was an internal transfer within my employer, got a job offer in the Toronto office and the company arranged for the work permit. My understanding is the work permit was issued based on no LMIA since it was an internal transfer.

Now I am thinking to get a PR on the CEC platform and submitted my initial profile. I found that my CRS score has 0 point on the "Arranged Employment". I submitted my old job offer and all the stuff but it seems I don't qualify for this point. I saw on IRCC homepage that "you can't use the same job offer that you used to get the work permit" and am wondering what that means.

I am not planning to move to another company right now and I don't think it makes any sense for my employer to issue another offer for me if I will continue to work for the same position.

What shall I do to get that 50 points for the "Arranged Employment"? I really need that score. I am currently at CRS score 402 and don't think I will get an invitation with this low score.

You need a updated job offer from your employer ensuring that you will have your job one year past receiving PR.

Thanks for the answer, it's really helpful. Regarding "one year past receiving PR", does the offer letter need to indicate this specific wording? How could they possibly know when I will be getting PR? Or is there a standard wording for this type of situation?

The letter must state it is permanent, full-time position. There is no standard wording...

The term of employment is for a minimum of one year from the date <Name> obtains permanent resident status.

My work permit is expiring within year and employer letter also have the same validity ( less than year) can i use this letter as Job offer
My work permit will be extended before expiry (3 months before) ...
Is it good to submit application with job offer less than a year and submit new job offer while submitting work permit extension ?

Does anybody able to claim additional 50 points with intra company transfer(LMIA exempt, Specialized knowledge)?

Below are my details:

1.I have completed my 1 year experience working in Canada at March 20201 on the close work permit, Intra company transfer (specialized knowledge, LMIA exempt).

2.I have a job offer letter which has been given by the employer stated, “temporary work permit for two years to be issued” dated Feb -2020.

3.I have a work permit valid until March 2022.
4.I have all my paystubs, T4 document, employment letter dated in April (mentioned Full time, Canada experience mentioned, annual salary)

Will these documents helpful for claiming those 50 points?

I received an invitation in express entry to apply for PR under Canadian experience class February 13th 2021 draw

- I got hired on the 25th of December 2019
My payday is biweekly, every 2 weeks.

Now here is the confusing part.
-I lost my first stub that came in on October 15 2019.
-My second paystub dated Nov 1st 2019 has 57 hours on it instead of the 60 hours required (30 hours a week, 2 week 60 hours)
The rest of my paystub from November 15 2019 to September 18 2020 all have over 60 hours on them.

-October 2nd 2020 paystub has 55 hours. After October my workload got reduced to part time due to COVID-19.

My Experience letter stated that I was employed from 25th of September to October 2020 and has worked 1,700 hours.

Will my application be rejected because of few hours short?
Should I apply with just experience letter and not upload paystubs?

No I cant for now. my invitation will expire in 10 days time and my work permit will also expire in few days

Can you get one letter stating that " you have worked on full time basis, from 'date' to 'date'"

If u get this letter then don't upload pay stubs just attach that letter.

What you need is an offer of employment.

To claim 50 (or 200) points for arranged employment you must have a written offer that meets the following conditions:
  • You are being offered a FULL-time job (30+ hours a week).
  • Skilled position based on NOC.
  • For at least one year after you become a PR.
  • Cannot be the same offered you received to get the current job.
  • Must not be older than 1 year.
  • Could be from your current employer or from another employer.
  • Offer must be supported by a LMIA, UNLESS you currently hold a LMIA exempt work permit AND are currently working for the employer named on the work permit AND have worked for that employer for at least one year AND have the written offer stating you will be employed for at least 1 year after becoming a PR.

You CANNOT use the offer for the job you are currently working.

You MUST get a new offer where it explicitly states that you are offered a position for at least one year after you become a PR, this must also be supported by a LMIA unless you qualify for LMIA exemption (most people don't)

If you apply with just experience letter you will most likely be refused.

How can you lose a paystub from September 2019 if you were just hired on December 2019? That makes no sense.

Also, it doesn't matter if you work less than 30 hours on a given week. It is okay. The important thing is that you have to add the hours you have worked every single week BUT CANNOT count any time worked beyond 30 hours.

Hence, if at any given week you worked 40 hours, for example, you can only count 30 hours for that week. Conversely, if you worked less than 30, say 25 hours, you would count all 25 hours.

For instance, let's say your worked the following hours over a period of 8 weeks:

40+40+40+30+40+40+20+25 --> these are your real hours worked, which total to=275 hours.

However, as you can only count up to 30 hours per week, for IRCC purposes you would only add the following hours:

30+30+30+30+30+30+20+25=225 hours

These 225 hours are the ones you can use towards calculating your work experience. Once they add up to 1560 hours, regardless of how long it takes (in your case since you have been working part-time it will definitely take more than 1 year =52 weeks).

Now, do you meet the 1560 hours after adding hours this way?

Also, if you lost a paystub, you should be able to request a copy from your employer. If not, you have 2 options, explain this when you submit your application and hope they believe you. Or second, wait until you have worked more hours and have enough paystubs to support the hours of work you are claiming.

does your work permit supports positive LMIA or LMIA exemption ?
