Can I submit my " application to change conditions, extend my stay or remain in Canada as a worker " application without the the details of intended work in Canada section. I'm a bartender a received a CAQ and LMO (lmia) almost two years ago. I'm filling this in as an open work permit, can anyone shed some light on this subject.

regards

Pat

You can only apply for an OWP if you are submitting an Inland spousal sponsorship application. If you are, you don't need to specify an employer or employment details.

Thank you for the reply Ponga, we are applying inland. My wife is Canadian and we live in Montreal together. Even tho I have a job I can still apply for the OWP, but can I still working until they make a decision on my application via implied status ?

That's the part of this OWP process that is such a slippery slope.

If you have an IEC or PGWP, the overwhelming majority of opinions here is that you should NOT continue to work. If this case, the implied status is only to cover you as a visitor.

If you currently hold a valid WP, I don't know if you're eligible to apply for a new OWP. Hopefully, someone else will chime in here and let us both know.

I have a valid work permit that will expire on the 30th of this month. I was told by campbell and cohen that I could apply for an OWP. i'm just trying to figure it out to see if what I'm doing is correct.

You can absolutely apply for the OWP and it will be issued based solely on your Inland application being received by CIC. You don't even need to wait for them to start processing the Inland application. As long as you are in status (which you currently are) it will be issued ~ 4 months after CIC receives the application. The OWP cannot be submitted before your Inland sponsorship application.

The real answer you seek is whether or not you can keep working after June 30th, right? That's the part that is sooooo murky.

Also keep in mind that if for any reason your Inland application (or OWP) is returned because it was incomplete, had an outdated form or was missing a signature, you would lose your implied status. For this reason alone, many people choose to extend their visitor status...just in case.
