Hi,
May I ask if I am able to sponsor my son without his father consent? I am divorced, I have my PR, and I have the full custody of my son who is 7 years old. In addition, I have a proof from the court that shows that my ex-husband used to assault me with no reason.

First things first: there's no reason whatsoever that would make it acceptable for your ex husband to assault you. You don't need to justify it by saying that he did it for no reason - whether you two were fighting or not, whether you think you deserved it or not, there is absolutely NO circumstance where it would be acceptable for one person to assault someone else. There is literally nothing you could have ever done to deserve what happened to you, so get that thought out of your head right now!!! I was assaulted by my ex as well, he spent over a year in jail for what he did to me, so I understand first-hand how difficult it can be to accept that you did absolutely nothing to deserve that. If you haven't already, I would suggest getting in contact with victim's assistance through your local police department, they can hook you up with free counselling which I personally found very helpful in moving on with my life and healing :)

That said, as long as your ex husband doesn't have parental rights to your child, you shouldn't need his consent. You should be applying under family class not as a humanitarian sponsor. Your son is your dependent and needs to be sponsored as such - did you receive your PR before or after your son was born? If your son was born before you were granted PR in Canada and is not a Canadian citizen, you should have added him to your PR application as a dependent.

Thank you for your rapid response. firstly, I already included my son in my application package while i was applying for the PR. However, The Canadian embassy in Egypt insists on submitting my son's father consent although i have the full custody of my son and i shown that I am unable to get the consent from my ex-husband. That's why, I had to remove my son from my application package and I got my PR. Now I am trying to sponsor my son without his father consent and I am trying to find a solution for this problem. My son's father will never give me the consent because he always does his best in humiliating me.

Hmm, in that case I would suggest seeking assistance from an immigration lawyer in your area, they will probably have worked on similar cases in the past and will know what actions you need to take. If you removed your son from your PR application but still brought him in to Canada as a dependent I'm not sure if it will cause issues for you or not, a lawyer is your best bet for making sure everything is done correctly. Did you need consent from your ex to bring your son to Canada in the first place?

You removed your son from your application to get your own PR?? Then the point is moot, you can never sponsor your son under the Family Class.

Both I and my son took the medical checkup so I have the right to sponsor my son. However. as I mentioned previously the embassy insists on submitting my son's father consent but i was unable to submit it. Concerning finding a lawyer, I am searching for a lawyer to consult but no one gave me a solution because all of them have never handled similar condition

Did you remove your son from the application fully or just list him as unaccompanying?

Perhaps you will be better off if you contact the Cohen lawyers whose website and forum this is. They will be more knowledgeable and have a lot of experience, and may be able to advise you on the specifics of your case.

Ok so it means he was 'non-accompanying', so long as he wasn't removed from the app completely.

please i need someone to help me i am in a big trouble i need to get my son with me from one side and my ex always uses my son to humiliate me although he has never asked to see him since our separation (5 years ago) and the embassy needs the consent to offer my son his visa from the other side

No one here can give you legal advice, free or not. Your case is complicated, spend the money for the legal fees or put your apllication at risk. You made a mistake removing your kid as you choose to leave him behind to get your PR, there is a chance that CIC will request his father permisison all over again . To apply under H&C is not easy, and for sure it is expensive if you seek legal advise , and i believe that you definitly should, so if you cannnot afford to pay 100 dollars for a consultation, you won't be able to pay for the professional fees either, give or take $3,000.00

I am sorry but you don't know what i was going through to say that i leave my son for the getting my PR. The embassy keep my application FOR ONE YEAR because of the decision of the Consul. I was advised to remove my son and get my PR then coming back to my country to find a solution to my son's problem, I never left my son and gave him my back and al the suffering I am going through now because i want to raise my son in Canada
