How to send outland application?

Hi,
We're in the process of finishing up our sponsorship application, but we can't seem to find out how to make sure it is sent and processed outland. On the document checklist (IMM5533E), under "Class of Application", these are the options:

1) "I'm living inside of Canada with my sponsor and apply under Spouse or Common-Law Partner in Canada Class."
2) "I'm living outside & apply under Family Class."
3) "I'm living inside & apply under Family Class."

So, we are applying under "Spouse or Common-Law", but there's no option for outland. The other options are for "Family Class". Also, my husband is currently with me in Canada on visitor visa, but I heard that it's not a problem and we still can send outland application. But how? Which option should we choose?

Family Class = outland spousal sponsorship.

You need to select option 3.

You could actually send an inland application and also append an open work permit. Your husband will be on implied status until the work permit comes ~4 months. Only downside is that he cannot leave Canada until the PR is issued.

He actually can. But if he is denied when trying to return to Canada his app is toast

Again, risk vs reward. With such risk, might as well stay in country until the app is processed and decision made.

So option 1 is for inland sponsorship and option 2/3 are for outland sponsorship?

We are considering sending our application inland, but we had a few concerns. One of them being that in the case that our application is rejected, we heard that we would not be able to apply again, unlike outland. Also, when it comes to processing times, inland used to take quite a bit longer than outland. According to the CIC website, it has been reduced to around 12 months, but is this accurate? Lastly, is it possible that my husband would get rejected for an open work permit?

Yes.

You can't appeal an inland refusal but you can most certainly apply again.

At this point, it is way too early to see if IRCC is going to be able to manage the 12 month processing time for inland.

Provided he has status when the PR/OWP app is sent and everything is submitted correctly with the right payment, he would be issued an OWP.

My husband was in Canada on working holiday and his visa expired. He applied to stay in Canada as a visitor, but the application has not finished processing yet, so he is on implied status and has been since his visa expired on March 7. There is still the possibility that his application could be rejected and it could still take over a month before we get an answer in regards to his visitor status. In this situation, would it be safe to apply inland? Would it be best to send in our application anyways, or to either wait for an answer (for inland), or apply outland?

He still has valid status. Whether to apply inland or outland is really up to you. Be sure to check the thread for your outland VO to see what the recent processing times are.
