How to get seized identity documents from IRCC

Hi I applied for refugee here in Canada in 2017 which got rejected multiple times. I got married last year and applied for spousal sponsorship and have received my AIP (approved in principle) and now IRCC has asked for my renewed copy of my passport in 30 days. Now I don’t have any of my documents from my country of nationality it’s all with either CBSA or IRCC. what should I do? My representative tell me to somehow get my passport renewed without my old passport but I can’t do any illegal work. Please help I just have 24 days

Yes they did but it’s mentioned on the notice I can apply for my documents only for 30 days after they’ve been taken.

I don't think you understand. You're not supposed to get the documents back. The whole reason they seize them in the first place is to either enable you to get PR if your application is approved or to remove you if it's not. The notice of seizure is proof of why you don't have your documents - they were taken by CBSA.

So what should I be doing in this case? I have to submit a passport that’s valid for further processing of my spousal sponsorship. I’m not a protected person I’m a failed refugee.

Like I said, if CBSA still has your dox, send the notice of seizure instead. That explains why you don't have them.

Hello, I applied for a TP to PR pathway and added my spouse who is a refugee claimant, his passport was seized by the CBSA at the port of entry, however IRCC is requesting for his passport now, can anyone please advise if they had similar issue and how they went about it..

I am sure she must have recieved a notice of seizure when the passport was collected when she claimed assylum.

You can send the notice of seizure to IRCC and explain that the passport is with seized by CBSA.

Update: I have been approved for PR. Anyone who has similar problem of not having their passport on hand should respond back to IRCC with the notice of seized documents.
