Hi,

I have DUI convection and I paid the fines in January 2016, how would the 5 year period be calculated. Also I have 12 months driving prohibition until Dec 2017.

Five years from December 2017. So you would be eligible to apply for rehabilitation in December 2022.

even thought the fines were paid in 2016, its just driving prohibition not probation?

The driving prohibition was a penalty you received as a result of the DUI. The five years starts from the time you complete all penalties related to your conviction. So that's December 2022 for you.

What's the status of your H&C application? Was it accepted? (I'm not sure an H&C application can be accepted if you are inadmissible but I could be wrong.)

Still waiting to hear something, but recently CIC acknowledge the receive of the application and requested RCMP record check which was submitted in March 2016. No idea why they wanted to see this, but hopefully something positive. I'm preparing for TRP to maintain legal status.

Your DUI was in Canada - right? If so, pretty logical for them to ask for the RCMP record. They're looking to confirm the charges / status of the charges.
