Hi All,
I have been living in canada since 2010 and around 2 weeks ago became a permanent resident (QSW) and living in Montreal.
I want to sponsor my nephew(My sister's son) who is in India.
(Small desc of him: My Nephew is around 10 years old and lost his mother when he is 10 months old and since then living with me (my parents), his father got married again and living seperately with his two kids and not taking care of my nephew)

Here are my questions:
1. Am I allowed to sponsor my nephew?
2. What are the requirements?
3. Do I need to have a legal guardianship before I can sponsor him?
4. I am in Canada, am I allowed legal guardianship in India?
5. Are there any similar case like mine that I can follow. If you know any case, please let me know what happened
6. If I can't sponsor, shall I bring him on study permit, if yes, how?

Thanks in advance.

regards,

Hi

No, you cannot sponsor him. Have a look here http://www.cic.gc.ca/english/immigrate/sponsor/relatives-apply-who.asp#who_cannot

You could only sponsor him if he was an orphan; as his father is still alive (regardless of whether he is in contact or not), your nephew is not eligible.

If the boy's father is willing to sign away parental rights, you could adopt him and then sponsor him as your child.

I am unfamiliar with the process of bringing a young child to Canada to study. I advise creating a separate post in the International Students section.

Hi All,
Thanks for your reply.
If I adopt him and sponsore him, how soon I could bring him to CANADA?.
I was checking CIC website, where it was showing it will take more 55 months. Is that true or am I looking at wrong place.
I want to bring him as early as possible, since my parents were unable to look after him as they are in 70's.

Before worrying about the immigration aspect, you need to see if the adoption is even possible. First and foremost, you must speak to the father and see if he is even willing to sign away his rights; this means that he will have no legal rights to the child in any way for the rest of his life. If the father will not sign, there is zero chance of you being able to adopt. If he is willing to sign, then you need to see if you qualify to adopt, as intercountry adoptions are a complicated process. See this page http://www.cic.gc.ca/english/immigrate/adoption/index.asp for more info. You need to contact the Quebec adoption authority, they will advise you further on both the Canadian and Indian processes.

If you are able to adopt him, it will take 54 months for the sponsorship app to be processed. While that is processing, you could apply for a TRV for him to come to Canada and stay with you throughout the process.
