Yes you will need to attach the certificate and if your son is under the age of 18 then he must be included on the application sheet as a dependent even if he is not coming to Canada he must under go a medical. No if or buts it is a requirement to be attached with your application.

I strongly encourage you to speak with a qualified lawyer, because you have a very complicated situation.
Most lawyers offer a complimentary phone consultation, which would at least give you an idea how (if at all possible) to fix this.

Don't gamble with your future.

Good luck!
I very strongly second this advice.

Your Canadian marriage is NOT legal, unless you declared your previous marriage AND divorce (you would have been required to furnish proof) when you applied for your marriage licence.

You absolutely need to get this sorted out before you even *think* about a PR application!

Yep definitely need a lawyer.
Most likely your process will involve getting your Canadian marriage annulled and/or de-registered, since it was illegal to do in the first place.

Then once that is complete, you will most likely need to pursue a common-law PR application for your new partner since you are still legally married to your first spouse. A common-law app is fine to do even though you're married to someone else, as long as you have proofs of the 1-year cohabitation.

With all due respect, it's not a good idea at all.
It would be misrepresentation and ban.
Apparently not.

Some good news friends :).....I followed up with my sister back in my country and luckily the court clerk found our divorce papers..the divorce had been granted back in Feb 2013 its only that we didnt follow up with it..Apparently she used violence and thats whats written in the divorce..I dont know what bearing this has on my new marriage when i send in application for PR.Our marriage certificate has come and my partner option c and all documents required..I was not given custody of our child .She has a new family and left the country.
on filling the form i explained that she started a relationship secretly while i was studying in canada and when i intervened a fight ensued....

Am currently on a student visa which is expiring this august..My objective is not to miss out on the pilot OWP program..Also what do i do??apply for visa extension..i drive my car with valid drivers licence what if police pulls me over..??Am sending my application this next week monday...Thks
