The laws to live and work in the States are very different from those in Canada. You will have to do some research in order to find the answer out about the US, but yes, if you live together for 12 months continuously and some or all of those months are in the US then you meet the burden.

There is the same basic burden for Common Law and Spousal sponsorship. You have to prove your relationship is genuine in both instances.... but with Common Law you have to prove that you have cohabited for a continuous 12 month period.

I am very desapointed of your message this morning because it seems like you don't get the situation in which you are right now. Please, do not take it personal because my goal is to help you find your mistakes and correct them before it get to late. Through my messages, I would like to be fair with you as well as with your girlfriend and with our system, that is the reason why on my previous posts I clarify that your situation have nothing to do with CIC but a negligence on your side. You will have to change the tittle of your thread to: “what can I do to regulize my situation vis-à-vis the immigration and stay together with my girlfriend” instead of put the blame on CIC.
Here is what I am getting from your messages:
1. You would like to stay with this person (girlfriend) because you are enjoying it
2. You are afraid of your status (Overstay) but the most dangerous thing is this last point
3. You do not want to face the reality and do something about it.
Please, correct me if I am wrong with any of my statements. If you get yourself set up, no body including CIC will care about you guys being together for life without get marriage certificate. Be real and suppose that you entered Canada with your PR do you think that CIC is going to be inverstigating with whom you are sleeping with?
I am sure that you would like to marry that girl today if she gives her okay but she is not going to do it because she eventually knows the law of 50/50. She knows that once she marry you, she will have to support you for the coming three years no matter what and if for some reason you guys have to divorce (very commun these days in the US and Canada) you will have to get half of everything. This is not a stupid woman and for her saying she is afraid to let you extend your visa because CIC may reject it and you may go back to the US is a red flag and I will interpret that as: "Hey! Do what you have to do to stay but do not count on me as your legal sponsor". How about that?. Also, she is not going to follow you to the US because she got her life set up here, she is also awared of the economic situation in the US where 15 milions are out of job without benefits as well as your situation that you have nothing to stend on. Be real and do the math, do you think that your lady will decide to go and put herself in the republicain mess? You my friend have the responsibility to be good with CIC if you would like to stay and enjoying your loving life. You have to put your man pants on and stop being only good in bed. It will be better for you to learn how to run and hide not only how to run unless you want to see your stuffs flying through the windows and that time if you still don't know how to hide, CIC is going to get you.
I don't know about you but if I were you, I will just go back to the US and file papers for my PR. If she loves you she is going to wait for you until you get everything in order but what do I know? I am just a 700 pounds gorilla... I will not spend one second with someone who wants me to go off my status in order to give satisfaction to her/his libido.

I just want to know more about what our options are if she sponsored me for common law, I didnt think that was so complex of a question. We want to move to the states because I can get a good job there that I already know about, but weve lived in Canada for the past year so she would have to sponsor me. I just want to know if we would be able to go back to the states as common law partners and both be able to work? You sound crazy by the way.

The point is that you want to gain the benefits of being a Canadian PR but you want to live in the USA.
Why does this make sense to Canada?

Shouldn't you be looking at immigration to the USA?

No name calling here please! If you don't know what I am saying here, how do you know that it is crazy stuff my friend? You guys can go to the US but in that case, you have to become her sponsor, helping her to get PR. Best thing to do, get the job as you stated here (congratulations!) and apply for her PR. It will take six months to get approve and she can start working. However, as a Canadian, she cannot be your sponsor in the US.
She has the right to go and stay in the US for a period of six months (she can also extend her visa one month before the end of the six months) so if you don't want to stay away from her she can go with you but she will not be able to work.
Yes, I am crazy but my papers are in order my friend.

I just want my options given to me. I've explained our situation yet I still dont know what we would have to do? ok listen, I have lived with her here in Canada for over a year, and I can prove that. BUT we want to live in the states and both be able to work. I know she can sponsor me since I've lived at her house in Canada for the past year, but that wont allow us to go back to the states and both work correct? So is there any way we could do that? I assume if she had lived with me in the states for a year then I could sponsor her, but we both need to be working there right away. I think the only option in my case is getting married.

I do not know the US immigration system and this forum is about Canadian immigration.
I guess that as you can prove that you have lived together for a year (no matter where), that you may be able to Sponsor her to live in the USA.
If you are using a spousal process (in Canada or the USA) I would be surprised if both of you could be working "right away".
It all takes time.

If she can get a job offer from a US company she can get a TN visa that would allow her to work immediately in the States.

I came over to the US and married and then applied for status as a wife and it took 11 months before my work visa was given to me. Of course that was 12 years ago so I dont know if things have changed or sped up.

The reason you're not getting clear answers is because you're not asking clear questions.

If you want to live together in Canada, she can sponsor you as common-law. The fact that you've overstayed will not affect the processing of that sponsorship. There is a chance they may require you to leave Canada if they realise you've overstayed, but since the application goes to Buffalo if you file through the outside-Canada sponsorship route (which is faster), most likely they'll process it all without even realising you're currently still in Canada illegally.

If you want to live together in the USA, this is the wrong forum. You being a Canadian PR won't help her live in the USA - it's a whole separate process - and if you want to live in Canada down the road you'd probably be best applying for PR then, when you intend to use it.

No, you have to be actually married. Most jurisdictions in the U.S. do not recognize common-law marriages. This actually came up on the PR application, as I recall--I had to say we didn't celebrate becoming common-law (which we did while still in the U.S.) because nowhere I have lived in the U.S. has recognized common-law relationships since before my parents were born.

This is the closest to a clear answer I've gotten even though I still dont have an answer lol..and yes my question could definately be clearer but for a simple question it gets quickly confusing while in writing. I asked on this forum because she as the canadian would be sponsoring me and I thought someone would know the answer. I need Leon, lol. Maybe if I ask a diff. question first I can get to an answer im looking for so heres my first question. If she as my canadian gf sponsors me as common law (weve both lived in canada for the past year) would that alow me to work in canada? If so, how long would it take?
