Hi,

I'm currently in Canada an open work permit (my husband is an international student). I have a full-time work as a Child caregiver since July. If I apply for PR on January 1 (gaining experience category), what will happen to the following:
1) My current work permit visa expires on March 2024 (but my husband will apply for PGWP). Will my open work permit be converted to an occupation-restricted open work permit (OROWP)?
2) What will happen to the visa application of my husband who will apply for PGWP on Dec 2023?
3) Will I be able to apply for PR on July 2024 (after gaining 1 year full-time experience as caregiver)?
4) What type of documents do I need from my employer?

1. You can apply for the Gaining Experience Category however you should extend your current work permit before March 2024 through an Open Work Permit Extension as the processing time for HCCP/HSWP applications is more than 2 years currently.
2. Your spouse can apply for PGWP without any issues. It will have no connection to your HCCP/HSWP application.
3. On July 2024, you must submit a reference letter and salary slips to IRCC as either HCCP or HSWP applicant. These documents will be attached to your original application submitted on Jan 2024
4. Already mentioned in point number 3.

What is the responsibility, duty and leverage Employer have after passport request of the applicant (employee)?

To me, being an employer who sent an offer letter to applicant, seems I have no responsibility, duty or leverage over employee. Its like an open work visa for employee to be child care giver from day one.

Am I correct here?
