Hi,

If my spouse applies for a study permit to he can start going to university while he currently holds the spousal OWP, will it invalidate the OWP? Or can he hold an OWP and a valid study permit simultaneously?

I couldn't find info on the IRCC website.

Thank-you.

Work permit won't be valid. He cant be a full time student and work full time. He will only have a study permit and will be allowed to work up to 20 hours, not considering breaks.
I wanted to go the other way. Had study permit and wanted to apply for a spousal OWP and was told that my study permit wont be valid anymore and I will have to stop studying.

"Work permit won't be valid."
Nothing affects the validity of a work permit. It is valid until it expires. And if it is an open work permit with no conditions, the holder can work.
I'm not sure who told you those things that you mentioned, but none of them is true.

It is true. You can't have both. And my immigration lawyer told me this. As soon as you get OWP your study permit would be cancelled. I'm assuming the same goes the other way.

Believe what you want. There is no basis in law for any of it. Study permits aren't cancelled. They expire naturally 90 days after you stop studying full time. If you don't stop studying full time they do not get cancelled because you have a work permit. And if you have the energy you can work full time (30 hours/week) or more. That work won't be counted as Canadian experience, but there is nothing stopping you.

Thank you for your advice. can you advise what you mean by “won’t be counted as Canadian experience”?

Thank-you

But if I want to stop studying and only have the OWP is it possible?
