Dear Gilani,

Congrates for yr marriage and wish u best of luck for yr immigration case. As fas the processing time is concerned, no one can tell u exact time lines. Your spouse will file yr case first at CPC and then on the approval of sponsorship yr immigration file will be transfered to Canadian High Commission Islamabad. For time lines in Islamabad mostly cases r now getting finalized within 3 to 4 months. But it varies case to case. If u live in Dubai for more than six months then u need to get the Police Clrearance Certificate from Dubai as well. You must see (www.cic.gc.ca) before completing yr immigration forms.

You can also find here the time lines of members of this forum to get the idea about estimated time line.

Kind regards,

Dear Gilinani,

Its very sad to hear that. Well I guess u can apply for TRV by providing all the evidence including the hospital records and doctor reports who are attending your father-in-law. You must also include the hospital or doctor recommendations that your father-in-law can't travel due to the severe medical situation.

Kind regards,

Dear Gilani,

One more thing I would like to add here which I forgot to mention..Ask your spouse to get the Airline refusal statement in which Airline states that they cant allow your father in law to travel due to his health. This will also reinforce ur case.

Are you kidding?
"Tell me if marriage is done through telephone " ????

Do you have a proper LEGAL in Dubai marriage certificate?

If you are not married yet- you are not a member of your fiancee family, and her father is a stranger to you, not a "father-in-law", and you definitely can wait when you fiancee in one or another way can come to you and get married.

Realistically. I can't imagine CIC allowing you to visit Canada on a TRV knowing that you have intentions of marrying a Canadian national. Once you are married, there are several other issues that arise that would give them pause about allowing you to enter the country. If you don't get married, you may apply for a TRV for the purpose of visiting friends but if CIC suspects your intentions for visiting they will probably not allow you to enter. Your best course of action as I see it is to get married, apply for PR as an 'outland' applicant in the spousal sponsorship program and once you are in the system you may be allowed to visit. They will not hold much confidence in your 'personal guarantee.' After all, everyone has one of those. But if you have applied for an outland PR they will recognize that you must return home at some point to complete the immigration process.

Best wishes!

and then we can get a legal documents through court proving that we got married by these witnases.
Well, I hope you are aware Canada is not a muslim country. However, somewhere on www.cic.gc.ca they admit that if you marriiage is legal in your country- it is legal in Canada too as soon as you can provide immigration services with a legal document. That means, pobably, your phone marriage will be legal for immigration purposes.
However, it does not allow you to immigrate into Canada "because you father-in-law is in a hospital". As his legal son-in-law you definitely can try to get a visitor visa. What chances do you have for getting it? Who knows?

I think that you can withdraw your work visa application and apply through the family class / spousal sponsorship program. Keep in mind that Canadian immigration ( and no doubt Immigration services for all soverign nations) don't really care about personal situations. They dont have time for each special need. They make the rules and state their requirements. It's up to us to abide by them.

listen Gilani! You have to do your home work before starting your application for sponsorship. You will have to mention in your form that you have applied for Canadian Immigration through skill class. Try to get married under normal circumstances. Telephonic marriage though acceptable could still create problem for you. Please note that CIC observes whether marriage has been consumated or not. You need to get married and provide the Nikkah Nama (marriage certificate) along with your application to be considered a family member as spouse. I dont think you will get TRV as your immigration process is already underway plus if you will mention you intend to go to your future inlaws, they might refuse you the TRV and advise you to get sponsorship from your spouse after getting married. You say you cant wait till 6 months to get married. I think its better if your fiancee visit you for few days in Dubai, get married, go back to Canada and apply for your sponsorship. In the meantime, you may apply for TRV with a request to visit your father in law who is in critical condition and cannot travel and wish to see you and your finance together as husband and wife. If all goes well you should be having the PR visa within 6 to 8 months times from today, which is not impossible.

First they have to approve her as a sponsor. That part of the application is processed in Canada and is supposed to take around 7 weeks. Then they send your application to Abu Dhabi. According to their website at http://www.dfait-maeci.gc.ca/abudhabi/IM-immigration-en.asp#family the standard processing time after they get the file is around 6 months so expect your visa around May 2009. Sometime during this process, they may ask you to come for interview, do medical etc.

The interview is to establish if you have a real marriage or if you have married for PR status. If you sent good supporting documents, you may not be called in for an interview. If you are called in, I assume they will ask you something about your wife that you would know if you are in a real marriage. Maybe somebody who has done such an interview can elaborate?
