Helping a Friend: Rejected Study Permit Application

Hello. Sorry for bothering everyone.

A friend of mine recently got accepted into a college program and applied for a study permit. Unfortunately, she got a rejection that basically states that:

1. Her intent on leaving Canada is not clear because she has insufficient funds.
2. The officer is unconvinced that she is able to, without working in Canada, pay her tuition fee.

She currently has sufficient funds JUST ENOUGH for her tuition and daily expenses. She is planning on staying with her aunt, hence she won't be paying rent.

Is there anything she could do to resubmit an application that can hopefully be approved?

It is always recommended to show funds for living expenses too. It is possible the Aunt may ask her to leave, or it may not work out. There is no guarantee (possibly in the minds of IRCC officers).

Did your friend pay the 1st semester or 1st year tuition? At this point, she should show living expenses too.

Order GCMS notes because point 1 is a general statement meaning program may not expand on career or education. IRCC wants to see that she can afford her studies. How much did she show? Did she pay tuition? How long is program? You said she had just enough but having accommodations for free is not factored in as it is not guaranteed.

  • I am not satisfied that you will leave Canada at the end of your stay as required by paragraph R216(1)(b) of the IRPR (https://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/section-216.html). I am refusing your application because you have not established that you will leave Canada, based on the following factors:
  • Your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable).
  • Pursuant to paragraph 220(a) of the IRPA, I am not satisfied that you have sufficient and available financial resources, without working in Canada, to pay the tuition fees for the course or program of studies that you intend to pursue.

Additional Info
  1. My friend included a signed letter with a Canadian ID from her aunt (the one she will be living with). The letter states that her aunt would be hosting accommodation.
  2. She did forget to include her proof of payment. She had paid the deposit for the first semester of the program she picked out already.

This is what I have so far. I'm sorry for the trouble and thank you guys so much for the help!

She did pay the deposit for the first semester, but apparently she forgot to include it in the application.

you always need to show MORE than what you're expected to have. can you give more details on how much money she showed vs tuition cost + city she'll be living in?

I'm talking about the first semester or the first year tuition. Not the $1000-4000 deposit, that most colleges/universities ask to confirm the admission and issue the applicant the LoA. That demonstrates commitment and availability of funds.

How much did she show in her bank accounts? How long is program? Paying a deposit is a couple hundred dollars, not paying tuition. Even if staying with aunt, she still needs to show funds for living expenses. Aunt can move, kick her out etc.

Hello! I included my bank statements showing that I’ve been saving almost my entire salary every month since I started my contract job so that I could pay for the tuition. I also provided my father's bank statements and a letter from him indicating that he would provide me financial aid. I think the mistake I made though is saying that I intended on taking up part-time employment in Canada as well to help fund my stay… and I didn’t realize that the IRCC wants you to prove you can fund your stay WITHOUT employment in Canada…

I have now paid my entire first semester of fees and I’m just waiting to get the receipt confirmation from the college. I am also going to include a breakdown of the second semester (and final payment of tuition) which will show that I will have approximately $9941 CAD to pay off my last $8645 CAD in fees. So I definitely have enough to cover me entire tuition for the year.

With respect to living expenses, I have a part-time job that I do remotely that I will be continuing during my stay in Canada. I also have the letter from my father stating he will provide me financial aid for living expenses during my stay. He was more specific this time and included that he would be giving me a monthly allowance starting at around $970 CAD (and more if needed). The city is Kitchener, Ontario, so the cost of living shouldn't be too bad.

In total, I will be showing that I will have around $1690CAD a month during my stay in Canada while studying. Thanks!

Hi! I’ve now paid my entire first semester of fees (a little over $9000CAD) and I’m just waiting for the receipts to include to re-apply for the visa. I also have provided a breakdown of my salaries that I will receive in the coming 6 months that will cover the entire second (and last) semester of my tuition, meaning I will be paying off the whole year of tuition by December 2023, and the school term starts in January 2024.

She should show she has enough savings in the bank right now to pay for her second semester tuition (I'm assuming her first year of studies is made up of two semesters) + $10K for living expenses. She should either show this bank balance herself and/or her father's bank balance.

I did include proof of funds: my bank statements showing my salary savings so far to pay my tuition and bank statements from my dad along with a letter from him stating that he would provide me financial aid for living expenses. However, I also included that I would take up a part-time job in Canada to help fund my stay which is probably their reason for denying (one of the GCMS note: Pursuant to paragraph 220(a) of the IRPA, I am not satisfied that you have sufficient and available financial resources, without working in Canada, to pay the tuition fees for the course or program of studies that you intend to pursue).

At this point however, I’ve now paid for me entire first semester and I’m just awaiting the receipts from the college to include in my re-application. I am also now including a breakdown showing that my following six months of salary will cover the entire second (and last) semester of tuition and so I will therefore have paid off for the entire program by December 2023, and the program starts in January 2024.
