One of my friend's refugee application was refused and received a letter from CIC to ask him to leave Canada two years ago. :-[

His Common Law Partner is willing to sponsor him through family sponsorship class. ;)

The question is: will CIC still require him to leave Canada after they submit the Family Sponsorship Application and ask him to stay in overseas to wait for the decision? My friend is afraid that he can never be able to come back to Canada after that. ???

Any suggestion for my friend's case? Can he stay in Canada to wait the sponsorship decision?

Is he still in Canada? I assume he did not leave when he was told to, so he has been in the country illegally for the past two years?

So he's been illegally here for 2 years? Well if he's not on CIC/CBSA's radar now, he will be as soon as any PR app is submitted.

He can try to apply, and hope that CIC will not make moves to deport him. However there's no guarantee of this. Some people say that if you apply INLAND CIC/CBSA will tend to defer any deportation order until stage 1 decision is made, but again no guarantees of anything.
 
In any case, if your friend was able to sponsor him, be prepared for CIC to take the application under scrutiny. CIC can view the refugee's action to marriage / common law as a marriage of convenient to avoid being deported. Your friend will have to prepare lots of proofs that the relationship is genuine to convince CIC that it is not a marriage of convenient. The refugee have to prove that he/she didn't get involved with your friend in pursuing a relationship after getting the deportation notice to avoid being deported.
 
failed refugee claimant... order to leave but stayed illegally anyway... now trying to get PR through common-law sponsorship...

oh boy....

it will be a long road. So many red flags here.
