I just got this:

This may include but is not limited to: joint ownership of rental property, joint residential leases, joint rental receipts, joint utilities accounts (electricity, gas, etc.), important documents that show the same address (e.g. identification documents, insurance policies, driver's licenses, etc.), joint bank accounts, etc.

Stat Dec of Common-Law IMM5409: A signed and completed Statutory Declaration of Common-Law Union form (IMM 5409) bearing original signatures

The above information/documents must be received in our office within 30 days from the date of this letter.

If we do not receive a response within the time allotted to you from the date of this notice, a decision will be made based on the information on your file, which could result in the refusal of your application.

Please reply directly to this email and put your application number in the title.

Please note:

So - does this mean we have to send in the IMM5409? I thought I remember asking and that was not needed. As proof of cohabitation we already provided them a printout from the city registrar's office here for each of us, showing that we have both been registered and living at the same address for more than 2 years now. Does that mean this wasn't enough? Also, maybe this is dumb but since this was sent to the principal applicant, does that mean the sponsor is approved? We never got anything saying so and in CIC it just says In Process for the SA

Also, I'm confused as to whether they want anything via mail with original signatures, or scanned in and emailed, it seems to ask for both there.....any help would be appreciated

I would just send whatever was requested as soon as possible. Some officers might do files differently.

And to where? Original signatures sounds like per post, whereas it seems like they want an email.

Anyone who has had this happen please? What did you do?

They are asking for original signatures, which means it needs to be mailed to CIC.

I would send them scanned documents of everything they asked you for. If it's possible and not a big hassle, I would sign the Stat Dec in front of a public notary (we did this and this is how we sent it with our application), then scan the document and send it by email.

Even though initially you sent the papers from the city registrar's office, sometimes it might not be enough for them. Not sure if you are living in Canada (I see that your VO is Vienna, so you are applying outbound). But if you do live in Canada and you pay any utility bill, you can have both names on the account, and you can register for online account and have a statement printed out after a few day, showing both names. Same for a join account at the bank. If you add the other person's name to an existing account, and print an online statement, so both names will show up, no need to wait 30 days for paper statement.

CIC (Paris VO) requested an updated form IMM5406E from us, dated and signed (the request came a few days after the file was moved to Paris). We filled up the missing info (it was our mistake that we skipped that portion), we signed it, scanned it and sent it to them by email.

IMM5409 is not a required document; CIC usually only requests it when people don't send proper common-law proofs. If all you sent was a prinout from the city office, then it's no surprise they are requesting it and other proofs; that is most definitely not enough .

You should have orginally included things like a lease/rental agreement, joint bank/credit card statements, mail in both and individual names covering at least a year, IDs with the same address etc.

Reply to the email with the Stat Dec and your other proofs, then mail the original Stat Dec to the VO.

Thanks, I guess it was naive to think the Registrar thing, copies of Id with addy were enough. It's my son and his fiancée who are applying and since she had the apartment for a few years before he moved in, lease and utilities etc were all in her name already so they just pay them together under her name :( So I'm not sure what they can add in other than a IMM5409 that's been authenticated at the Canadian Consulate her.

Also, I was gravely ill from 2012-2014 and his fiancée lived with us during that time to help me (she still kept the apt they now share but never slept there as I needed 24 hour help). Obviously they didn't sign a lease with me, and then once I was better they went to live in her apartment. Do you think an authenticated (also at the consulate) declaration from me (Sponsor's mother) attesting that they additionally lived together with me for the 2 years previous to living in their current apartment would help?

He never received any mail in 2 years living at that address? He doesn't have a bank account or credit card?

There are many proofs that can be used and he really needs to find some. Mail, statements, payslips, letter from the landlord, letters from neighbors, letter from employer, letter from doctor etc.

She needs to submit proofs as well. The lease and utility bills should be sufficient.

Sorry, jetlagged and going on 3 hours sleep. They both get all their mail at that address, so there is lots of mail they could submit. But what they don'T have is anything addressed to them BOTH. So they can each send in things like Tax return papers, payslips, bank statements etc that show the same address, but the envelopes are not addressed to them both. Does that make more sense?

It doesn't have to be in both names. The need to submit stuff covering at least a one year period.

I really don't understand how IMM5409 can prove the common law relationship. I can be in relationship for a week and go to the notary declare that I am in relationship for 2 years. Bills and bank account more old than imm5409 but cic doesn't think in that way obviously

IMM5409 is not proof, hence why CIC has asked for all of the other stuff as well.

I think the IMM is just so they can hold you accountable easily if you are caught misrepresenting. Like how they make you swear to tell the truth in court, and if you are caught lying they can throw you in jail over it.
