Help Please Family Class Sponsorship Issue

Hi,

Would anyone please guide me on how to resolve the issue based on Reg: 117 (9) (d)????? We got married just before my sponsor landed but he didn't know that he should have update marital status right away. He reported to CRA when he filed tax return but when applied to sponsor me he got a response with an answer that he is ineligible. Now he mentioned that application will still go through the process since he checked to proceed with application anyways and the application has been forwarded to concerning visa office.

What are the options now ...please help

Please read this thread - it explains the issue. When a PR applicant submits an application as a single person, and then marries during the process, they must report the marriage (or even a common-law relationship) to the visa office that is processing their file (assuming they want their new partner to accompany them to Canada). That way the new partner is added to the existing PR application and is processed with the original applicant so that both can be approved and land together in Canada. But this does delay processing of the application and landing, and some applicants try to circumvent the delay by NOT reporting their marriage or relationship. IF they do this, they are banned from sponsoring that partner to Canada in the future - because it's assumed they basically withheld information to give themselves an advantage in getting to Canada.

Being that you actually married before your husband landed, and he didn't inform CIC of the change in his marital status, he is ineligible to sponsor you as his spouse. You'll have to find an alternate avenue to immigrate to Canada - like a Skilled Worker application. It's very unfortunate that some people do not realize this is the "rule" - but it's probably not possible for you to overturn the decision, even in an appeal.

He faxed CRA with all the details thinking that his info will be updated.
Now I heard that CRA doesnt share that info with IMMI
When he applied to sponsor me ..he got reply that he is ineligible
Application has been forwarded for further process and we don't know what's going to happen

I hope things go in our favour ...Any advise will be much appreciated...

The application will be refused, as you are not a member of the family class. He will probably be reported for misrepresentation.
