My impression is, whether your spouse is applying for PR with you doesn't make a difference.
in this case, the OP will inform CIC that he is intending to get a divorce and no longer wish the spouse to accompany him :)

You have two options, as others have said.

1) You can try to convince her to go along with the application, there's nothing that would force her to come to Canada. Even if you don't think you will reconcile, there is always the possibility, and if you remove her from your application, that option is dead.

2) If you are both 100% certain is over, what legal options are available to you? Can the marriage be annulled? If you have to go through a lengthy divorce proceeding, even just demonstrating that one of you has applied for divorce should be sufficient. Then add a letter like Veronica suggested.

Fully agree with you & yes i m sure i will not gonna do that today only i meet the lawyer about my case hopefully this week i will send them the affidavit states that i m going to remove my spouse

I think we are damn sure this will not works do i have to consider the option 2 to remove her from application.
What i worry about is that 2 months back only they ask the additional documents to prove the relationship & now if i remove her may be they think i m misrepresenting my status which gives me sleepless nights.
I m meeting with lawyers to get some good advice but they are also not sure about this scenerio.
Hopefully this week i will ready a affidavit with the lawyer to send cic.

Please put some light if anyone get some additional info.

One more thing after submitted this letter is CIC ask you anything else or your application delay & have u submit this letter after medical or before.

Cic asked for proof of separation coz I filed as legally separated, so I made an affidavit about my failed marriage and have it notarized, and requested a declaration from from CPP Ottawa that my estranged husband is excluded as part of my family member and that he will not accompany me in canada. Those documents are still to be sent tomorrow coz I have a consultant who assists me in my application.

I haven't received PPR yet though my medical results were already received by immigration,. Also that declaration form can only be requested from CPP Ottawa, it's a declaration relating to paragraph 117(9)(d) of the immigration and refugee protection act, try googling it. So those documents are the only missing link so I can have my PPR. Hopefully soon.

Hi All,

me too in the same boat!!!! :( :( :(

I am yet to apply for my PR under CEC. I got married in October 2013 and soon after our marriage we had frequent fights. I came to know from one of my friend that my wife is having a boyfriend backhome and so she is least interested in continuing her relationship with me. She married me only to come to canada.

after knowing all this I do not want to include my wife in my application. but how can i do it with out a divorce or separation. As her intentions are to get here so she will never agree to this and how should i exclude her from my application.


Seniors pleas help.... its really bad....

This might be relevant to people who are contemplating informing CIC of their failed marriages.

Visa applicants: Do not get involved in a false marriage. CIC will refuse your visa and may ban you from travel to Canada for two years. This will stay on your CIC record forever.

CIC knows that even genuine marriages can fail. But, if you enter into a marriage of convenience and come to Canada as an immigrant, Canada may:

•take legal action against you and
•deport you from Canada.

I sincerely suggest applicants who have failed marriages after applying to inform CIC as soon as they can. I am sure Immigration understands that people do break up. It may delay your process, but it will be considered a fraud to bring someone to the country when you aren't really married anymore.

I do understand that marriage of convenience is fraud. I married her to spend my life with her but its her who dumped me and married me to come to Canada. How can I prove this? Please help me I need to apply for my PR under CEC as soon as possible as my work permit expires in July. As if I get my AOR only then I can apply for my bridging visas. Kindly please advise.

I need to apply for PR under CEC excluding my spouse. What documents can I include to do so ……... Like any declaration or an oath … any such kinda document please help or tell me if I can meet any one..

I understand that you married her to spend the rest of your life with her. However, your marriage has failed now and it is quite clear to you that she married you only to come to Canada. If you continue to support her, it will be a fraud. You can choose not to include her in your application. That is your right and I am sure that CIC will understand it. You can file for a divorce or if you are legally separated you can submit that proof. Since I am not well versed with this situation I am not the best person to tell you what you can submit to show that your marriage has failed. Other forum members who have had similar experience shared some valuable thoughts (please check and contact them if necessary). I believe it is best that you do not include her in your application and submit necessary proof.

Honestly, why do you want to jeopardize your chance of starting your life in a new country because of someone else? :)

thanks Hope1957... let me see who can help me ... i do not have a legal separation document nor can i file for a divorce as she is not gonna give me .. so i am stuck now. donno what to do... i can just state on paper that she dumped me and i am not including her in the PR application hope CIC understands. .... fingures crossed ..hope for the best.
