Help!! my pay stubs weekly hours is different than from my reference letter

Hello Seniors,

i worked one year for a client through an agency. I sometimes worked for 35 hours per week, 30, 37.5, 40 or 45 hours per week which also shows on my pay stub. But my reference letter says 40 hours per week. Is that going to be an issue for the visa officer?

Overall, i have worked more than 2000 hours within one year. Should i submit my paystubs or not? I also have my T4 and NOA which i am submitting to CEC.

Help!

I think As long as you worked minimum 30hrs/week for 52weeks (or) 1 year....You should be fine.

Just make sure all the weeks you have worked are 30hrs/week or more.

First count no of weeks you worked more then 30hrs (vs) no of weeks less then 30hrs.

Then you add up all the hrs of the weeks that you worked less then 30hrs to complete 52 weeks of more then 30hrs.

so remove 56 out of 13 = 43 weeks of 30+ Hrs.

Now you need 9 weeks of 30+ hrs to be eligible for CEC = 9weeks * 30 Hrs = 270 Hrs.

Can you let us know, the no of hrs for each week(#13) that has less then 30 hrs ?

So it looks like you qualify (just barely!).

But the hours could be an issue if , for example, you're paid an hourly rate and the VO calculates the
rate * 40hrs per week * # weeks worked in 2012,
and compares that to the T4 - they should be pretty close.

If they are not, if you think it might be a problem, you can attach a letter of explanation, saying "40 hours per week" was an approximate, attach a table of your calculations, and photocopies of your paystubs (try and keep the pages to a minimum).

BTW - you should have letters from both your employer and the client where you actually performed the work -

I have received my GCMS notes today and I had applied with a similar situation as u.

In my GCMS notes says my work experience needs second review, so I suggest u to have full 52 weeks of 30hrs experience and apply. I suggest you to send in all the pay stubs, t4 and record of employment if u have, this would help the officer to cross check if he has any questions and helps you to prove them that u qualify.

Also my suggestion is to have couple of extra weeks of work experience may be like 55 weeks of 30 hrs just to be on a safe side.

instead of saying 40hrs/week, why not say an average of 40hrs/week or biweekly if ur getting biweekly paystubs?. I was in a similar situation but my employer was not that specific. she mentioned that I works an average of 48hrs biweekly and this was never an issue with CIC. in order to avoid complicating issues, u need to include all ur paystubs from scratch and let ur employer provide another ref. letter for u. make sure that the annual salary ur employer wrote is exactly the same as in ur paystubs, T4s and NOAs. I am saying this based on my experience and I have now been approved. Since u made up to 2000hrs, for sure u are good to go. During my time, I never threw away any single hrs, infact, I calculated all the hours from my paystubs and it was up to 2300hrs before I applied. I also worked more than 52 weeks ( never try to accumulate hrs and apply b4 52 weeks). so don't throw away ur hrs and keep wasting ur time. I also worked with employment agencies. CIC never asked me to get any ref. letter from clients but rather my employers provided everything that I needed from them so each case is unique. it is all up to u and which kind of job or contract ur doing. I was on PGWP and I don't have that issue. Hope this helps. All the best :) :) :)
