Good day to all forum mates!

I received my MR yesterday, for my Wife, Son and my daughter to my Ex.,
My problem is my ex dont want to communicate, cooperate or in other words dont
want to give anything from my daughter.,
Though I explained to her everything that Im just declaring my
daughter coz she is.,
When I submit my application, I include sworn statement that my ex dont want to cooperate
and a picture from my daughter facebook.,
Coz as I stated they dont want to help me.,
Now I dont know what to do, I called CIC earlier and the agent told me precisely that
I have to have the Medical exam of my daughter eventhough I told him the
situation.,
Hope someone here experienced/experiencing this problem
and you can help me.,

Hi Unico,

I have seen more than a few in your situation as I work in the field of immigration law. Firstly I want to know, is your daughter by your Ex immigrating to Canada with you? I am assuming that your Ex has custody of your daughter and she is not coming with you, but I want to confirm it with you first.

If your daughter is not immigrating with you, it is possible for your application to go through without having your daughter's medical results. However, if you land in Canada without submitting your daughter's medical results, you forfeit any right to sponsor your daughter for immigration to Canada in the future. Unfortunately, there is very little leeway for exceptions, even if your Ex is uncooperative and you are not at fault for the situation.

Yes my daughter is in custody of her mother and shes not coming with me,,.
I understand that if I cant submit my daughter's medical exam, I cannot bring her here for the future.,
What can I do to go through to my application without her medical examination?

If you indicate to CIC that you cannot obtain your daughter's medical results, give the reasons, and confirm that you are willing to forfeit any right to sponsor your daughter in the future, your application should process to completion normally.
