To quote my own message to you on September 19th:

2) They don't report you and you get in in which case, you have 2 options:
a) Try to renew your PR card. You will likely end up in appeal again as you don't meet the residency requirements.
b) Stay for 730 days without leaving or trying to renew and then renew. They must now renew, no appeal.
Therefore, do not try to apply to renew your PR card now unless you want to end up with an appeal which you may lose.

As for sponsoring your daughter, I have heard of people sponsoring successfully without meeting the residency requirements so I don't know if they check that at the time of sponsorship. It is another risk to take.

If you want to play it perfectly safe with everything, you would wait for 730 days before you try to apply for your PR card or sponsor your daughter and you would not leave Canada at all during that time.

Pls tell me that am i perfectly safe now ? I want to ask one thing that can canadian immigration people inbetween call me or send any communication of not meeting residency requirement? Pls put light on this. So that accordingly I could send my resignation also to my employer in India....

Lets say I have never heard of a person who was just living their daily life in Canada being contacted by immigration and told that they don't meet the residency requirement. That could be brought up if you leave and try to re-enter or if you apply to renew your PR card and possibly if you want to sponsor someone.

Leon Guide me on one more thing, As I have reached Canada with get reported at POE. Now PR woill gett expired in the next month. As per the system I can get it renewed only after com[pleting 730 days if there is no solid humantarian ground. If I go to immigration authority after completing 730 days means approximately 2 years after, Can they question me for my expired PR card & reason for not renewing the card before expiry? Suppose now i stay here continuouly for two years and at the end they say me that my card canot be renewed then my future will be at stack... Also if they renew my card after two years then from which date they will renew my card means from the expiry date of card or whern I submit the request? Pls put light on these aspects...

When you apply for a new PR card, the only thing that matters is the 5 year period before you apply to renew. They can not go back in time and say you lost your PR earlier already. They are only allowed to look at the 5 years immediately before you apply. If you have 730 days in those 5 years, you are ok.

When they renew your PR card, from the date they renew, you get another 5 years.

I think you still need to wait until you have satisfied your PR requirements before renewing your PR card.

If she rents and apartment and asks for a bank statement to her new address, even utility bill would be better, she can bring that to OHIP and register before her PR card expires. She will still not get the health card until after 3 month waiting period but they should not have to see her PR card again.

Dear Leon,

I think in OHIP documentation is defferent from MSP, I was sendning copy of PR card, passport copy actual arrival dates to BC. So they should see PR validation dates and issue MSP card, am I right? If they will see that PR will expire after 1 month, how can I be eligible for MSP. Am i right or not? I just want to make plans and want to be sure that I will get MSP even my card will be expired after 1 month. Thanks.

Your PR card can expire but your PR status doesn't expire. You still have your landing papers to prove your status.

Thanks for your post.
I am also planning to return to Canada this May 2012 but I will not meet the residency requirement. My PR is still valid until August next year.
Can you tell us where in Canada did you enter when you return?

So you got in by the skin of your teeth back in October but still your PR was not important enough for you to stay until you had met the residency requirements?

The only option left for you is that you try to get a US visa and try entering Canada on the land border but they are likely to give you more trouble this time because now your PR card is expired and they know you don't meet the requirements. They still have to let you in but they could report you this time.

Your other option is applying for a travel document at the Canadian embassy in India but then they will decide right then and there if they will let you keep your PR or not. If you were taking care of a dying relative, you might have humane and compassionate grounds for having not met your requirements. Other than that, they will probably refuse.
