Hi

I've been studied in Canada for almost 9 years. But I had to go back to my country for personal reasons and after that I planned to go back to Canada
However Seneca College located in Toronto wouldn't give me the acceptance letter in time, so I had to go to Canada with 6 month TRV(Travelling Visa).
At that time I only had 2and half months to apply study permit before school starts, so I hurried and applied.
But immigration office did not give me any further information (Medical form) for atlest 2months. I had to attend classes because I didn't want to miss the classes and lose college GPAs.
My visa agent who help me apply study permit told me that I shouln't attend school but however there are few people who received study permit while attending school.
At that time I did not know I was violating the immigration law. During the process my TRV was ending soon so I had to extend it to avoid illegal stay.
I continued contating CIC or any immigration office for my status.
3 months later they responded to me with letter saying "Still pending medical results" so, I asked if can please send me the forms again to my email address but no answers returned.
About total 6months of asking questions and issuing more information they sent me a letter rejecting the study permit. but as I looked into this letter's issued date, it was already finalized 3 months ago.
To shorten this, I asked to send me a medical forms again and waited for response and they did not answer to my request but just rejected my VISA 5 days later.

So in result, I studied without study permit and I had to stop my school and return to my country.
I came to my country and waited about 6 months to cool down my situation, and reapplied study permit for Sept term with the letter supporting why I voilated the law by studying in Canada without permit.
But it has been rejected due to my history of having contravened the conditions of admission on a previous stay in Canada.

So, please help me to solve this situation. Or how about writing a letter explaining my situation and ask for advises in officer's point of view?
Please share your experiences or thoughts.
Thank you.

Applied in Canada while attending Seneca College in Toronto
First apply on Feb 2012
First reject letter received on early Oct 2012
Left country 20 days after letter received.
Applied Study permit in Korea after 6 month
Rejection letter received 2 months later.

You were studying in Canada for 9 years. How? Did you have a valid study permit for those years?

What was the reason given for your first rejection?

Which country are you from?

I studied in Toronto since 2002 with valid study permit.
I returned back to Canada with TRV on Dec 2011 and accidently studied illegaly until Oct 2012
The reasons of first rejection were purpose of stay and did not provided Medical forms.
And I am from South Korea...

I'm afraid your chances are not very good. It's almost impossible to get approved for a study permit after studying illegally.

Your best bet would be to study in South Korea for the time being and re apply for further studies in Canada after a few years.

Dude, its normal to have rejection for the reasons above stated,WHile applying for Visa this time, make sure you attach one document showing that you are good in studies and you scored good in studies. Well, its not illegal to stay in any country. Its just like you were not suppose to do study after that time. YOu did, that is not a problem. JUst state or make an interview with those.
2ns thing, you can come to canada as TRV but for study permit you need to go back to south korea again.
ANd bring me some kimchi.. when ever u come.. lol...

I recommend to approach a good immigration lawyer, such as Niren and associates.

Cheers!
